o potrditvi Memoranduma o mednarodnem razvojnem sodelovanju med Republiko Slovenijo in Republiko Makedonijo za obdobje od 2013 do 2015

1. člen

Potrdi se Memorandum o mednarodnem razvojnem sodelovanju med Republiko Slovenijo in Republiko Makedonijo za ob­dobje od 2013 do 2015, podpisan v Ljubljani 25. julija 2013.

Memorandum se v izvirniku v angleškem jeziku in prevodu v slovenskem jeziku glasi:
MEMORANDUM
ON INTERNATIONAL DEVELOPMENT COOPERATION BETWEEN THE REPUBLIC OF SLOVENIA AND THE REPUBLIC OF MACEDONIA FOR THE PERIOD 2013–2015
The Republic of Slovenia and the Republic of Macedonia (hereinafter “the Parties”),
Based on the Agreement on Development Cooperation between the Government of the Republic of Slovenia and the Government of the Republic of Macedonia, signed on 10 June 2004,
Have agreed on the following:
I FUNDS EARMARKED FOR BILATERAL DEVELOPMENT COOPERATION BETWEEN THE REPUBLIC
OF SLOVENIA AND THE REPUBLIC OF MACEDONIA
FOR THE PERIOD 2013–2015
Article 1
In the Framework Programme of International Development Cooperation and Humanitarian Assistance of the Republic of Slovenia for the period 2013–2015, the Government of the Republic of Slovenia has earmarked funds in the approximate amount of EUR 1,426,788 for bilateral development cooperation between the Republic of Slovenia and the Republic of Macedonia.
Pursuant to the bilateral agreement, development cooperation between the Republic of Slovenia and the Republic of Macedonia focuses on environmental protection, particularly the protection of water resources, waste water management, and energy efficiency. A particular emphasis is placed on the strengthening of economic development, balanced regional development, the modernization of the public administration and trainings in the context of EU accession.
II DEVELOPMENT PROJECTS AIMED AT ENHANCING ECONOMIC AND SOCIAL INFRASTRUCTURE
Article 2
The Parties have agreed to allocate approximately EUR 845,788 in support of development projects aimed at enhancing economic and social infrastructure in the Republic of Macedonia.
When selecting projects, the Parties took into account
the strategic priorities of the Republic of Macedonia and the
need for its further economic and social development, the
promotion of balanced regional development and environmental
protection.
In the period 2013–2015, the Parties plan to undertake
the following projects in the field of economic and social
infrastructure:
1 The final stage of the construction and the startup
of a public waste water treatment plant in the Gjorče
Petrov Municipality (the donation of the Republic of Slovenia
shall amount to EUR 138,430).
2 The construction and start-up of a public drinking
water treatment plant in the Lozovo Municipality
(the donation of the Republic of Slovenia shall amount to
EUR 291,956).
3 The renovation of the drinking water treatment
plant in the Štip Municipality (the donation of the Republic
of Slovenia shall amount to EUR 415,402).
Article 3
In case of projects aimed at enhancing economic and
social infrastructure, the standard donation of the Republic
of Slovenia does not exceed 40%. The remaining funds are
ensured by the recipient country.
Any changes to the co-financing share must be authorised
by the Ministry of Foreign Affairs of the Republic of
Slovenia on a case-by-case basis.
The recipient country decides at its own discretion how
to close the financial construction of a project.
Article 4
The recipient country shall select a contractor in line
with its national public procurement legislation and positive
practice on development cooperation projects established
with other countries. The signatory party of the beneficiary
country shall notify the signatory party of the donor of the
appointed contractor. The signatory party of the beneficiary
country shall ensure that the appointment procedure causes
no delays in project start/schedule. The procedure also takes
into account the capacity and past experience in similar
projects of potential contractors, understanding of the work
processes in development cooperation projects between the
two countries, and the knowledge of applicable construction
laws and standards of the beneficiary country. In special
cases in which the Republic of Slovenia provides the major
share of funds or at the request of the recipient, the Centre
for International Cooperation and Development selects, in
agreement and with participation of donation recipient, a
contractor on the basis of a tender published in the Republic
of Slovenia in line with the Slovenian legislation on public
finances and public procurement.
III TECHNICAL ASSISTANCE
Article 5
The Parties have agreed to provide funds in the approximate
amount of EUR 276,000 for activities in the field
of technical assistance.
Article 6
Taking into account the active support of the Republic
of Slovenia for the Republic of Macedonia as regards its
European future and integration into the European Union
and adoption of EU standards and norms, in the period
2013–2015, the Republic of Slovenia will provide, through
its ministries, their agencies and government offices, to the
Republic of Macedonia expert technical assistance in the
amount of up to EUR 120,000 (EUR 40,000 annually). The
technical assistance shall be provided upon request from the
Secretariat for European Affairs, as Government institution
responsible for management of the EU Accession process.
Article 7
The Republic of Slovenia will provide to the Republic of
Macedonia expert technical assistance to be implemented by
the Regional Institution – Centre for Excellence in Finance
for a public accounting project in the amount of EUR 156,000
(EUR 78,000 in 2013 and EUR 78,000 in 2014).
IV OTHER FORMS OF COOPERATION
Article 8
The Parties shall promote development activities undertaken
in the Republic of Macedonia by non-governmental
organisations from the Republic of Slovenia, and other forms
of bilateral development cooperation, such as projects at the
regional level in or for several partner countries concurrently.
In the Framework Programme of International Development
Cooperation and Humanitarian Assistance for the period
2013–2015, the Government of the Republic of Slovenia
has earmarked EUR 85,000 for the co-financing of activities
of non-governmental organisations, namely EUR 30,000 for
the conclusion of the three-year project and EUR 55,000
for a new project for the period 2014–2015. The area of activities
shall be consulted with the Secretariat for European
Affairs.
From the funds allocated for international development
assistance of the Ministry of Economic Development
and Technology of the Republic of Slovenia, EUR 220,000,
namely EUR 70,000 in 2013, EUR 75,000 in 2014 and
EUR 75,000 in 2015, will be channelled through the United
Nations Industrial Development Organization (UNIDO) for
development projects in tourism.
V FINAL PROVISIONS
Article 9
Specific activities and details of their implementation
shall be coordinated by the Joint Committee for Development
Cooperation of the Ministry of Foreign Affairs of the
Republic of Slovenia and the Secretariat for European Affairs
of the Republic of Macedonia.
Article 10
In case of any problems during the realization of specific
projects, the identification of additional development
projects or other unforeseen developments in the Memorandum's
implementation, the Parties may agree, via the
Joint Committee, to amend the selection of projects. Such
arrangements shall be formalized in the form of an annex,
which shall be an integral part of the Memorandum and enter
into force in accordance with the provisions Article 11 hereof.
Article 11
The Memorandum shall enter into force on the thirtieth
day following its signing and shall remain in force until
31 December 2015. Activities that are underway or have
not been concluded shall be subject to the provisions of
the Agreement on Development Cooperation between the
Government of the Republic of Slovenia and the Government
of the Republic of Macedonia until their conclusion unless
otherwise agreed by the Parties.

MEMORANDUM
O MEDNARODNEM RAZVOJNEM SODELOVANJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE MAKEDONIJE ZA OBDOBJE 2013 DO 2015
Republika Slovenija in Republika Makedonija (v nadalje­vanju »pogodbenici«) sta se
na podlagi Sporazuma med Vlado Republike Slovenije in Vlado Republike Makedonije o razvojnem sodelovanju, podpisanega 10. junija 2004
dogovorili o sledečem:

I. PREDVIDENA SREDSTVA ZA DVOSTRANSKO RAZVOJNO SODELOVANJE MED REPUBLIKO SLOVENIJO IN REPUBLIKO MAKEDONIJO ZA OBDOBJE 2013 DO 2015

1. člen

Vlada Republike Slovenije je z Okvirnim programom razvojnega sodelovanja in humanitarne pomoči Republike Slovenije za obdobje 2013 do 2015 za dvostransko razvojno sodelovanje med Republiko Slovenijo in Republiko Makedoni­jo predvidela sredstva v skupni vrednosti do 1,426.788 EUR.
Skladno z meddržavnim dogovorom se razvojno sode­lovanje med Republiko Slovenijo in Republiko Makedonijo osredotoča na varovanje okolja, predvsem na zaščito vodnih virov in gospodarjenje z odpadnimi vodami ter energetsko učinkovitost. Pri tem se daje posebni poudarek krepitvi go­spodarskega razvoja in uravnoteženemu regionalnemu raz­voju ter posodobitvi javne uprave in usposabljanju s področja približevanja EU.

II. RAZVOJNI PROJEKTI ZA KREPITEV GOSPODARSKE IN DRUŽBENE INFRASTRUKTURE

2. člen

Pogodbenici sta se dogovorili, da se za podporo razvoj­nim projektom za krepitev gospodarske in družbene infra­strukture v Republiki Makedoniji predvidijo sredstva v okvirni višini do 845.288 EUR.
