Članek obravnava (ne)ustreznost nove ureditve izvajanja pogrebne dejavnosti v Republiki Sloveniji. Svojci pokojnika izbirajo izvajalce na trgu prosto, po svoji presoji. Vendar pa primerjalne študije in raziskava avtorice kaže na to, da se posameznik ob izgubi svojca, ki mu mora oskrbeti pogreb, ne obnaša kot običajni potrošnik na trgu. Z metodami družboslovnega raziskovanja avtorica kritično analizira različne sisteme po svetu. Posebno pozornost nameni tržnemu sistemu, ki se je razvil v ZDA. Prav tako primerja oba sistema (monopolni in licenčni sistem), v katerih se je v RS doslej izvajala pogreba dejavnost, ter z rezultati utemeljene teorije predlaga popravke veljavnega licenčnega sistema. Članek obravnava poleg pravno-ekonomske analize tudi psihološko-sociološke vidike obnašanja uporabnikov storitev in tudi tistih subjektov, ki zagotavljajo storitve.

The article analyses the (in)adequacy of the new arrangement of funeral services in the Republic of Slovenia. The relatives of the deceased choose provider of funeral services on the market freely. However, comparative studies and author’s research indicate that an individual does not behave as a normal consumer on the market in the case of a loss of a relative to whom the funeral needs to be provided. In the article, the author uses methods of social research. She critically analyses different systems around the world and gives special attention to the market system that developed in the U.S. The author also compares both systems (monopoly and licensing system) in which the funeral services in the Republic of Slovenia have been carried out so far, and proposes corrections of the valid licensing system due to the results of the grounded theory. In addition to the legal and economic analysis, the article deals with the psychological and sociological aspects of the behavior of users of services as well as of providers of services.
