POVZETEK
Avtor v članku predstavi predpostavke, časovne okvire in vsebino zahtevkov kupca na podlagi stvarne napake pri prodajni pogodbi: popravilo in zamenjava, znižanje kupnine, odstop od pogodbe ter odškodninski zahtevek. Posebno pozornost namenja razliki med splošno ureditvijo v slovenskem OZ ter ureditvijo potrošniške prodajne pogodbe v ZVPot, ki je posledica prenosa Direktive 99/44/ES o potrošniški prodaji in garancijah v slovensko pravo. V tem kontekstu obravnava tudi sodbo Sodišča EU v zadevah Weber in Putz (C-65/09 in C-87/09), ki se nanaša na obseg in omejitve kupčevega zahtevka na zamenjavo blaga z napako in njen pomen za slovensko pravo. Slovenija je 3. člen Direktive uresničila na poseben način, brez prenosa posebne hierarhije kupčevih zahtevkov, zato so možnosti za uresničevanje sodbe brez spremembe zakona v nekaterih pogledih omejene.
SUMMARY
The author presents the prerequisites, time-limits and the contents of the remedies of the buyer in case of material defects in a contract of sale: repair, replacement, price-reduction, termination and damages. Special attention is given to the differences between the general sales law in the Slovenian Obligations Code and the consumer sales law in Consumer Protection Act, which implements the Directive 99/44/EC on consumer sales and guarantees. In this context author presents the judgement of the Court of Justice of the EU in cases Weber and Putz (C-65/09 and C-87/09) and its significance for Slovenian law. The case deals with the scope and limitations of the buyer’s claim for replacement of non-conforming goods. As Slovenia has implemented art. 3 of the Directive without transposing the special hierarchy of the remedies of the buyer, the judgement – in the absence of a law reform – is difficult to follow in some respects.
