POVZETEK
Avtor v prispevku s pomočjo analitične in deskriptivne metode utemeljuje tezo, da so storitve visokošolskega izobraževanja v skladu s sistemskimi temelji tržno-socialne države mešana javno-zasebna dobrina (merit good) in da veljavna slovenska ureditev, po kateri se določajo obseg in viri financiranja storitev visokošolskega izobraževanja, ne temeljijo na sistemskih temeljih. Posledica take ureditve se kažejo na številnih področjih, kot razkorak med ponudbo in povpraševanjem in neustreznem razmerju soodvisnosti med ekonomskimi in družbenimi koristmi visokošolskega izobraževanja, ki je pogoj za optimalno družbeno dobrobit. Na sistemskih temeljih avtor utemeljuje potrebo po spremembi pravnih podlag, v skladu s katerimi bo državi v obsegu, ki je utemeljen z javnim interesom, naložena skrb za zagotavljanje financiranja visokošolskih izobraževalnih storitev, v delu, ki je utemeljen z zasebnim interesom uporabnikov teh storitev, pa ob spoštovanju načela socialne države. iz drugih virov (kot so šolnine).
SUMMARY
By means of analytical and descriptive methods the author of this article justifies the thesis that higher education services are mixed public-private goods (merit goods) in compliance with the systemic foundations of the social-market state and that the valid Slovene regulation according to which the scope and sources of financing higher education services are determined is not based on the systemic foundations. Consequences of such regulation are evident in numerous fields as a gap between demand and supply and in inadequate balance of interdependence between economic and social benefits of higher education, which is a condition for optimal social well-being. On systemic foundations the author gives reasons for the need to change the legal bases in accordance with which a concern for the provision of financing of higher education services will be imposed on the state in the scope that is explained by the public interest, in the section justified by the private interest of users of these services and for financing from other sources (such as tuition), under consideration of the social state principle.
