Avtor v članku obravnava udeležbo laikov pri sojenju v obliki prisedniškega sodišča oziroma skabinskega sistema odločanja (tudi t. i. model kolaborativnega laičnega sodišča). Avtor predstavi razloge, ki jih zasledujejo demokratične države pri uvajanju prisedniškega sistema (namesto porotnega sistema). Razvoj prisedniškega sistema avtor predstavi od njegovih začetkov v Nemčiji pa vse do današnje veljavne ureditve v Nemčiji. Prisedniški sistem sistematizira tudi s primerjalnega vidika, pri čemer poudari njegove prednosti in slabosti. Glede na to, da obstaja prisedniški sistem tudi v Sloveniji, se postavlja enako vprašanje kot v primerljivih sistemih glede prihodnjega razvoja take udeležbe laikov pri sojenju. odločanja (nem. Schöffengerichte) kot oblika udeležbe državljanov pri sojenju.

The author discusses the lay participation in the trial in a lay assessor system or the Scabine system of judicial decision-making (also the so called model of collaborative lay courts). The author explains the reasons for introducing the lay assessor system (the Schöffen Courts instead of the jury system) in democratic countries. He also presents the development of the Scabin system or lay assessor system from its beginnings in Germany to the present regulation in Germany. He continues with the comparative perspective of lay assessor system, whereby he exposes its advantages and disadvantages. Given that the lay assessor system (the Schöffen Courts) exists also in Slovenia, the same questions are raised as in comparable systems regarding the future development of such lay participation in judicial decision making.
