Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi*:
S P O R A Z U M <br />
O SODELOVANJU MED MINISTRSTVOM ZA KULTURO REPUBLIKE SLOVENIJE IN GENERALNO UPRAVO ZA TISK IN OBJAVE LJUDSKE REPUBLIKE KITAJSKE
Vlada Republike Slovenije, ki jo zastopa Ministrstvo za kulturo Republike Slovenije (v nadaljevanju MK), na eni strani in Vlada Ljudske republike Kitajske, ki jo zastopa Generalna uprava za tisk in objave (v nadaljevanju GUTO), na drugi strani (v nadaljevanju pogodbenik in skupaj pogodbenika) sta se,
KER ŽELITA poglobiti medsebojno spoznavanje in krepiti prijateljstvo med Republiko Slovenijo in Ljudsko republiko Kitajsko,
KER ŽELITA razvijati in krepiti tudi dvostransko sodelovanje na področju tiskanih medijev, objav in varstva avtorskih pravic,
DOGOVORILA:
Namen tega sporazuma je v skladu z notranjimi zakoni pogodbenikov določiti splošen pravni okvir za sodelovanje med MK in GUTO na področju tiskanih medijev, objav in varstva avtorskih pravic na podlagi enakopravnega statusa in vzajemnih koristi.
Namen tega sporazuma je tudi razvijati koristno sodelovanje in izmenjavo med strokovnjaki in institucijami obeh držav, da bi izmenjavali najboljšo prakso in razvijali zmogljivosti.
Da bi spodbujala in omogočala lažji razvoj svojih sektorjev za obveščanje in medije, pogodbenika soglašata, da se bosta redno posvetovala o vseh zadevah v skupnem interesu.
Da bi omogočila posvetovanja, pogodbenika, kadar je primerno, spodbujata medsebojne uradne obiske.
Pogodbenika spodbujata sodelovanje v sektorjih tiskanih medijev, objav, tiskanja, distribucije in avtorskih pravic v obeh državah. V zvezi s tem se pogodbenika zavezujeta, da bosta podpirala in omogočala dvostranske seminarje, skupne delavnice za usposabljanje, izmenjavo obiskov in druge dejavnosti, ki so sprejemljive za oba pogodbenika.
Pogodbenika podpirata sodelovanje pri objavah med založniki obeh držav in spodbujata predstavitve, prevajanje in izdajanje uglednih literarnih del ter drugih političnih, gospodarskih, zgodovinskih in znanstveno-tehnoloških publikacij iz države drugega pogodbenika v svojem domačem jeziku. Pogodbenika soglašata, da zagotovita državna sredstva založnikom za prevod in izdajo takih uglednih knjig, če se jima zdi primerno.
Pogodbenika dejavno spodbujata svoje založnike za udeležbo na Pekinškem mednarodnem knjižnem sejmu (BIBF) v Pekingu in na knjižnih sejmih v Sloveniji. Po načelu vzajemne koristi pogodbenik založnikom drugega pogodbenika pomaga pri udeležbi na omenjenih knjižnih sejmih.
Pogodbenika se posvetujeta in sodelujeta pri varstvu avtorskih pravic ter krepita varstvo del, objavljenih v njunih državah, v skladu z ustreznimi zakoni v svoji državi.
Sporazum začne veljati z dnem, ko kitajska stran prejme uradno obvestilo slovenske strani o dokončanju notranjepravnih postopkov, potrebnih za začetek veljavnosti sporazuma.
Sporazum se sklene za tri (3) leta in se lahko podaljšuje za nadaljnja triletna obdobja.
Sporazum se lahko spremeni pisno z dogovorom med pogodbenikoma. Spremembe začnejo veljati v skladu s prvim odstavkom 5. člena.
Pogodbenik lahko sporazum kadar koli odpove s pisnim uradnim obvestilom drugemu pogodbeniku. Odpoved začne veljati tri (3) mesece po dnevu prejema takega obvestila.
Ob odpovedi sporazuma njegove določbe še naprej veljajo za nedokončane programe, ki so bili začeti na njegovi podlagi.
Vse spore zaradi razlage ali uporabe sporazuma pogodbenika rešujeta medsebojno in prijateljsko s posvetovanji in pogajanji.
Pogodbenika soglašata, da vse projekte, ki se izvajajo na podlagi sporazuma, v celoti urejajo zakoni pogodbenika, ki je gostitelj projekta.
V potrditev tega sta podpisana, ki sta bila za to pravilno pooblaščena, podpisala ta sporazum.
Sestavljeno v Ljubljani 15. 4. 2011 v dveh izvirnikih v slovenskem, kitajskem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob morebitni različni razlagi prevlada angleško besedilo.

A G R E E M E N T <br />
ON COOPERATION BETWEEN THE MINISTRY OF CULTURE OF THE REPUBLIC OF SLOVENIA AND THE GENERAL ADMINISTRATION OF PRESS AND PUBLICATION OF THE PEOPLE'S REPUBLIC OF CHINA
The Government of the Republic of Slovenia, represented by the Ministry of Culture of the Republic of Slovenia (hereinafter: MoC), on the one part, and the Government of the People's Republic of China, represented by the General Administration of Press and Publication (hereinafter: GAPP), on the other part (hereinafter: "Party" and collectively "Parties");
DESIROUS of deepening mutual understanding and strengthening the friendship between the Republic of Slovenia and the People's Republic of China;
FURTHER DESIROUS of developing and reinforcing bilateral cooperation in the areas of the press, publication and copyright protection;
HAVE AGREED as follows:
ARTICLE 1
This Agreement is intended to establish a general legal framework of cooperation between MoC and GAPP in the areas of the press, publication and copyright protection on the basis of equality of status and reciprocal advantages in compliance with the domestic laws of either Party.
This Agreement is further aimed at developing favourable cooperation and exchange between professionals and institutions of the two countries with a view to sharing best practice and developing capacity.
ARTICLE 2
To facilitate and enhance the development of their information and media sectors, the Parties agree to consult each other on a regular basis on all matters of mutual interest.
The Parties shall, with a view to facilitating consultations, promote and encourage mutual official visits where appropriate.
ARTICLE 3
The Parties shall encourage cooperation in the press, publication, printing, distribution and copyright sectors of the two countries. In this regard, the Parties undertake to support and facilitate bilateral seminars, joint training workshops, exchange visits and other mutually agreeable activities.
The Parties shall support cooperation in publication between publishers in the two countries and encourage the introduction, translation and publication in each Party's home language of prestigious literature works and other political, economic, historical, and science and technology publications from the other Party's country. The Parties agree, if they deem appropriate, to provide state funds to publishers to translate and publish such prestigious books.
The two Parties shall proactively encourage the respective publishers to take part in the Beijing International Book Fair (BIBF) in Beijing and the book fairs in Slovenia. Subject to the principle of mutual benefit, the two Parties shall facilitate the publishers of the other Party in taking part in the above-mentioned book fairs.
ARTICLE 4
The Parties shall consult and cooperate in the area of copyright protection and enhance protection for works published in either country, in accordance with the relevant respective laws.
ARTICLE 5
The Agreement shall enter into force on the date on which the Chinese Party receives the notification from the Slovenian Party that the necessary requirements for its entry into force have been fulfilled.
The Agreement shall be concluded for a period of three (3) years and can be extended for successive three-year periods.
ARTICLE 6
Any amendments to this Agreement shall be mutually agreed between the Parties and shall be effected in writing. The amendments shall enter into force in accordance with the Article 5 Paragraph 1.
ARTICLE 7
Either Party may terminate this Agreement at any time by a written notification to the other Party. The termination shall become effective three (3) months from the date of receipt of such a notification.
At termination, the provisions of this Agreement shall continue to govern any unexpired programmes commenced under the agreement.
ARTICLE 8
Any dispute arising in the interpretation or application of this Agreement shall be resolved mutually and amicably by the Parties through consultation and negotiation.
ARTICLE 9
The Parties agree that all projects undertaken pursuant to this Agreement shall be governed entirely by the laws of the Party hosting the project.
IN WITNESS WHEREOF, the undersigned, being duly authorised thereto, have signed this Agreement.
Done in Ljubljana on 15 April 2011 in two originals in the Slovene, Chinese and English languages, each text being equally authentic. In the case of differing interpretations, the English text shall prevail.
