1.10 Technical advice on a case-by-case basis in the event of a significant nuclear accident or incident originating or involving the nuclear facilities, regulated by both organisations.
2. ADMINISTRATION
2.1 The exchange of information under this Arrangement will be accomplished through letters, reports and other documents, and by visits and meetings arranged in advance. A meeting will be held periodically to review the exchange of information, to recommend revisions to the provisions of the Arrangement. The time, place and agenda for such meetings shall be agreed upon in advance.
2.2 An administrator will be designated by each Party to co-ordinate its participation in the overall exchange. The administrators shall be the recipients of all documents transmitted under the exchange.
2.3 The transmitting Party does not warrant the suitability of any information for any particular use or application and the application or use of such information exchanged or transferred between the Parties under this Arrangement shall be the responsibility of the receiving Party.
2.4 Recognising that some information of the type covered in this Arrangement is not available within the Parties to this Arrangement, but is available from other agencies with whom the Parties are associated, each Party will assist the other to the maximum extent possible by organising visits and directing inquiries concerning such information to the appropriate agencies concerned. The foregoing shall not constitute a commitment of other agencies to furnish such information or to receive such visitors.
3. EXCHANGE AND USE OF INFORMATION
3.1 Information received by each Party to this Arrangement may be disseminated freely without further permission of the other Party unless otherwise indicated by the transmitting Party.
3.2 A Party receiving under this Arrangement confidential information or proprietary information shall respect its confidential or proprietary nature, provided such information is clearly marked with restrictive legend and accompanied by written instructions relating to further use.
3.3 Co-operation under this Arrangement shall be governed by the laws and regulations of the respective countries. Any dispute or questions between Parties concerning the interpretation or application of this Arrangement arising during its term, must be settled by mutual agreement of the Parties.
4. FINAL PROVISIONS
4.1 This Arrangement shall enter into force on the date of the last notification by which the Parties notify each other about completion of their internal legal conditions for entry into force and, subject to paragraph 2 of this Article, shall remain in force for five years unless extended for a further period of time by written notice of the Parties.
