2. člen

Besedilo sporazuma se v izvirniku v slovenskem in angleškem jeziku glasi:*

SPORAZUM <BR>MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE INDIJE O SODELOVANJU V KULTURI, UMETNOSTI, IZOBRAŽEVANJU, ŠPORTU IN JAVNIH OBČILIH

Vlada Republike Slovenije in Vlada Republike Indije (v nadaljnjem besedilu “pogodbenici“) sta se

v želji, da bi čim bolj uspešno sodelovali v kulturi, umetnosti, izobraževanju, športu in javnih občilih;

v prepričanju, da bo tako sodelovanje prispevalo k boljšemu razumevanju in poglabljanju odnosov med državama na različnih ravneh;

dogovorili o naslednjem:

I. ČLEN

Pogodbenici si prizadevata za spodbujanje in krepitev sodelovanja v kulturi, umetnosti, izobraževanju, športu in javnih občilih.

II. ČLEN

Pogodbenici podpirata medsebojno sodelovanje, da bi spodbudili in razvijali odnose med njunimi ustanovami, namenjenimi izobraževanju, usposabljanju in raziskovanju v kulturi, umetnosti, izobraževanju, športu in javnih občilih.

III. ČLEN

Vsaka od pogodbenic v skladu s svojimi sredstvi in zahtevami na priporočilo druge pogodbenice sprejme državljane na študij, usposabljanje, opravljanje raziskovalnega dela in specializacijo v svojih ustanovah, dejavnih na področju kulture, umetnosti, izobraževanja, športa in javnih občil.

IV. ČLEN

Sodelovanje v znanosti ureja Sporazum o znanstvenem in tehnološkem sodelovanju med Vlado Republike Slovenije in Vlado Republike Indije, ki je bil podpisan 31. januarja 1995 v New Delhiju.

V. ČLEN

Pogodbenici bosta ukrenili vse potrebno, da bi olajšali izvajanje tega sporazuma.

VI. ČLEN

Za namene izvajanja določb tega sporazuma se pogodbenici dogovorita, da bosta ustanovili mešano komisijo, ki bo sestavljena iz enakega števila predstavnikov vsake pogodbenice. Cilji te mešane komisije bodo:

a) oblikovanje podrobnega programa izmenjave in

b) periodično pregledovanje izvajanja programa izmenjave.

Mešana komisija se bo sestajala po potrebi, kot se bosta medsebojno dogovorili pogodbenici.

VII. ČLEN

Ta sporazum začne veljati na dan izmenjave uradnih obvestil o tem, da so ga odobrili pristojni organi pogodbenic.

Ta sporazum velja pet let, njegova veljavnost pa se samodejno podaljša za nadaljnja petletna obdobja, če ga katera od pogodbenic šest mesecev pred iztekom vsakokratnega petletnega obdobja ne odpove s pisnim obvestilom po diplomatski poti.

Sestavljeno v New Delhiju dne 16. decembra 1996 v dveh izvirnikih v slovenskem, hindu in angleškem jeziku, pri čemer so vsa besedila enako verodostojna.

Ob različni razlagi je odločilno angleško besedilo.

A G R E E M E N T <BR>BETWEEN THE GOVERNMENT OF THE     REPUBLIC OF SLOVENIA AND THE     GOVERNMENT OF THE REPUBLIC OF INDIA     ON COOPERATION IN THE FIELDS OF CULTURE, ARTS, EDUCATION, SPORTS AND MASS-MEDIA

The Government of the Republic of Slovenia and the Government of the Republic of India (hereinafter referred to as the “Contracting Parties“);
    Desiring to cooperate effectively in the fields of culture, arts, education, sports and mass media;
    Being convinced that such cooperation will contribute to a better understanding and enhancement of relations between the two countries at different levels;
    Have agreed as follows:

ARTICLE I

The Contracting Parties shall endeavour to encourage and strengthen cooperation in the fields of culture, arts, education, sports, and mass media.

ARTICLE II

The Contracting Parties shall promote mutual cooperation to encourage and develop relations between their respective educational, training and research institutions in the fields of culture, arts, education, sports and mass media.

ARTICLE III

Each Contracting Party shall receive, as far as its own resources and requirements shall permit, the nationals recommended by the other Contracting Party for study, training, carrying out research work and specialisation in its institutions engaged in the fields of culture, arts, education, sports and mass media.

ARTICLE IV

Cooperation in the field of science is regulated by the Agreement between the Government of the Republic of Slovenia and the Government of the Republic of India on Scientific and Technological Cooperation, signed in New Delhi on 31 January 1995.

ARTICLE V

The Contracting Parties shall take all appropriate measures to facilitate the implementation of this Agreement.

ARTICLE VI

For the purpose of carrying out the terms of this Agreement, the Contracting Parties agree to set up a Joint Commission consisting of an equal number of representatives of each Contracting Party. The objectives of the Joint Commission shall be:
    a) to formulate a detailed Programme of Exchange and
    b) to keep under periodical review the implementation of the Programme of Exchange.
    The Joint Commission shall meet as and when necessary, as mutually agreed between the Contracting Parties.

ARTICLE VII

This Agreement shall enter into force on the day of the exchange of notification of its approval by the competent authorities of the Contracting Parties.
    This Agreement shall remain in force for five years and shall be automatically renewed for subsequent five year periods unless either Contracting Party terminates it by written notification through diplomatic channels six months prior to the expiration of the respective five year period.
    Done at New Delhi on 16 December 1996 in two originals in the Slovene, Hindi and English languages, all texts being equally authentic.
    In case of different interpretation, the English text shall prevail.
