2. člen

Sporazum se v izvirniku v slovenskem in angleškem jeziku glasi:*

T R G O V I N S K I      S P O R A Z U M    <BR>MED VLADO REPUBLIKE SLOVENIJE IN VLADO ARABSKE REPUBLIKE EGIPT

Vlada Republike Slovenije in Vlada Arabske republike Egipt (v nadaljevanju pogodbenici) sta se z namenom razvijanja tradicionalnih odnosov med narodoma obeh držav in v želji, da bi okrepili in pospešili trgovinske stike med državama na podlagi enakosti in vzajemne koristi, dogovorili naslednje:

1. člen

Pogodbenici bosta sprejeli vse ukrepe, potrebne za spodbujanje, olajševanje, krepitev in popestritev poslovnih in trgovinskih odnosov med državama v skladu z zakoni in predpisi, ki veljajo v obeh državah.

2. člen

Uvoz in izvoz blaga in storitev potekata po pogodbah, ki jih sklenejo fizične in pravne osebe obeh držav, v skladu s cenami in standardi mednarodnega trga.

Pogodbenici nista odgovorni za obveznosti fizičnih in pravnih oseb, ki izhajajo iz njihovih pogodb.

3. člen

Plačila med državama se bodo opravljala v prosto konvertibilnih valutah v skladu z zakoni in predpisi, ki veljajo v obeh državah, z možnostjo, da fizične in pravne osebe obeh držav lahko uporabljajo tudi druge načine plačila, o katerih se dogovorijo v svojih pogodbah.

4. člen

Pogodbenici si bosta prizadevali za pospeševanje trgovine med državama, vključno s skupnimi vlaganji, z ustanovitvijo trgovskih centrov, trgovino v tranzitu in drugimi različnimi načini in sredstvi sodelovanja.

5. člen

Pogodbenici bosta spodbujali in olajševali sodelovanje na mednarodnih in lokalnih sejmih in razstavah vsaka na svojem ozemlju, v skladu s predpisi, ki veljajo v njunih državah.

Glede tega pogodbenici soglašata, da bosta blago za sejme in razstave, ki ni namenjeno za prodajo, oprostili carin in drugih podobnih dajatev, na podlagi zakonov in predpisov, ki veljajo v njunih državah.

6. člen

Pogodbenici bosta v skladu z zakoni in predpisi, veljavnimi v njunih državah, dovoljevali izvoz in/ali uvoz blaga, oproščenega davkov, carin in drugih dajatev po sistemu začasnega uvoza.

7. člen

Pogodbenici bosta spodbujali sodelovanje in izmenjavo obiskov med gospodarskimi in industrijskimi zbornicami ter drugimi podobnimi organizacijami kot tudi med poslovneži obeh držav.

8. člen

Da bi pogodbenici spodbudili uresničevanje tega sporazuma in določili načine in sredstva za pospeševanje in razvijanje trgovinskih odnosov, bosta ustanovili skupno trgovinsko komisijo, sestavljeno iz predstavnikov ustreznih organov ene in druge strani (v nadaljevanju komisija).

Komisija se bo sestajala na željo katerekoli od pogodbenic izmenično v Republiki Sloveniji in v Arabski republiki Egipt, da bi razpravljala o problemih, ki bi nastali med uresničevanjem tega sporazuma, sprejemala priporočila in predloge za nadaljnje razvijanje gospodarskih izmenjav in reševala probleme v zvezi s tem.

9. člen

Spori v zvezi s pojasnjevanjem, razlago in uresničevanjem določb tega sporazuma se rešujejo s pogajanji ali na načine, ki so priznani po mednarodnem pravu.

10. člen

Določbe tega sporazuma bodo tudi po njegovi spremembi ali prenehanju še naprej veljale za pogodbe, ki se sklenejo v njegovem okviru in med njegovo veljavnostjo.

11. člen

Ta sporazum je treba odobriti v skladu z zakoni, veljavnimi v obeh državah in začne veljati z datumom zadnjega obvestila, s katerim pogodbenici druga drugo obvestita, da so izpolnjeni vsi pravni postopki za uveljavitev tega sporazuma.

12. člen

Ta sporazum velja dve leti in se vsakokrat avtomatično podaljšuje še za eno leto, če ena od pogodbenic pisno ne obvesti druge tri mesece pred dnem prenehanja veljavnosti, da ga odpoveduje.

Sestavljeno in podpisano v Ljubljani dne 12.3. 1997 v dveh izvirnikih v slovenskem, arabskem in angleškem jeziku, pri čemer sta obe besedili istovetni. Ob morebitnem neskladju je odločilno angleško besedilo.

T R A D E     A G R E E M E N T    <BR>BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE ARAB REPUBLIC OF EGYPT

The Government of the Republic of Slovenia and the Government of the Arab Republic of Egypt (hereinafter referred to as the Contracting Parties) for the purpose of developing the traditional relations between the peoples of the two countries, wishing to strengthen and promote the trade relations between two countries on the basis of equality and mutual benefit, have agreed as follows:

Article 1

The Contracting Parties shall take all necessary measures to encourage, facilitate, strengthen and diversify commercial and trade relations between the two countries, in accordance with laws and regulations in force in both countries.

Article 2

Import and export of goods and servicies shall be effected through contracts concluded between natural and legal persons of the two countries on the prices and standards of the international market.
Neither of the Contracting Parties shall be responsible for the obligation of natural and legal persons resulting from their contracts.

Article 3

The payments between the two countries shall be effected in free convertible currencies in accordance with the laws and regulations in force in both countries, with the possibility for natural and legal persons in both countries to use also other ways of payments to be agreed upon through their contracts.

Article 4

The Contracting Parties shall make effort to promote trade between the two countries including establishment of joint ventures, commercial centres, transit-trade and other different ways and means of cooperation.

Article 5

The Contracting Parties shall encourage and facilitate participation in international and local fairs and exhibitions held in their territories, in accordance with the regulations in force in their respective countries.
In this respect, the Contracting Parties agree to exempt the goods for fairs and exhibitions, which are not intended for sale, from custom duties and other similar duties in accordance with laws and regulations in force in their respective countries.

Article 6

The Contracting Parties shall, in conformity with the laws and regulations in force in their respective countries, allow the export and / or the import of goods exempted from taxes, custom duties and other duties under temporary admission system.

Article 7

Both Contracting Parties shall encourage the cooperation and the exchange of visits between the chambers of commerce, chambers of industry and other similar organisations, as well as between businessmen of both countries.

Article 8

To encourage implementation of this Agreement and determine ways and means of promoting and developing trade relations, the Contracting Parties shall establish a Joint Trade Commission composed of representatives of their respective authorities (hereinafter reffered to as the Commission).
The Commission shall meet at the request of either party alternately in the Republic of Slovenia and the Arab Republic of Egypt, to discuss problems which may arise during the implementation of this Agreement, adopt recommendations and proposals to further develop commercial exchanges, solving the problems in connection hereto.

Article 9

Disputes related to the explanation, interpretation and implementation of the provisions of this Agreement will be settled through negotiations or by recognized methods in the international law.

Article 10

The provisions of this Agreement shall continue, even after its modification or termination, to govern contracts concluded within its framework and during its validity.

Article 11

This Agreement is subject to approval in accordance with laws valid in both countries and shall come into force on the date of last notification, by which the Contracting Parties inform each other about fulfillment of legal procedures concerning the ratification of this Agreement.

Article 12

This Agreement is valid for a period of two years and shall be automatically renewed for periods of one year each, unless either Contracting Party informs the other by a written notice to terminate it three months before the expiring date.
Done and signed in Ljubljana on 12th March 1997 in two originals in the Slovene, Arabic and English languages, both texts are equally authentic. In case of discrepancies, the English text shall prevail.
