Desiring to implement the provisions of the Transfer of Pension Rights Act of 28 April 2010 (hereinafter referred to as “ZPPP”) and the provisions of the EIB Staff and Pension Scheme Regulations related to the transfer of pension rights,
Resolved to conclude a legal and technical agreement on the transfer of pension rights between the EIB Pension Scheme and the System of Pension and Invalidity Insurance of the Republic of Slovenia, and vice versa
have agreed as follows:
Article 1:
Objective and Scope
(1) The Government and the EIB, referred to as the contracting parties to this Agreement, shall regulate with this Agreement the procedure of transfer of pension rights for insured persons (hereinafter singularly referred to as the “Insured Person”) who transfer pension rights under the System of Pension and Invalidity Insurance of the Republic of Slovenia into the EIB Pension Scheme, and for the staff members transferring pension rights from the EIB Pension Scheme into the System of Pension and Invalidity Insurance of the Republic of Slovenia.
(2) Unless otherwise specified in this Agreement, the transfer of pension rights above shall be based on the provision of ZPPP. Should this latter be amended, the present Agreement may be amended accordingly, subject to the agreement of the parties to this Agreement.
Article 2:
Definitions
For the purposes of this Agreement, the terms used herein shall have the following meaning:
Member: all persons compulsorily subscribed to the EIB Pension Scheme.
Staff and Pension Scheme Regulations: the texts of the Staff Regulations and Pension Scheme Regulations of the EIB, as adopted by the Board of Directors of the European Investment Bank in accordance with Article 31 of the Rules of Procedure of the European Investment Bank, as approved by the Board of Governors of the European Investment Bank pursuant to Article 7 of the EIB Statute (Protocol 5 of the EU Treaties – Official Journal of the European Union of 9 May 2008).
Net Current Value: the actuarial equivalent of all pension entitlements, referred to as Capital Sum Payable upon Forfeiture of Insured Status in Article 71-1 of the EIB Pension Scheme Regulations, which a member has acquired in the EIB pension scheme on the date of transfer and corresponding to the concept of “actuarial equivalent of the pension entitlements” in accordance with the ZPPP.
Transfer Value: cash sum representing revalued contributions for compulsory pension and disability insurance in the Republic of Slovenia for the period before taking up employment with EIB. The transfer value shall also include balances on the insured person's account resulting from payments for compulsory and voluntary supplementary pension insurance in the Republic of Slovenia, as referred to in Article 3 of the ZPPP.
System of Pension and Invalidity Insurance of the Republic of Slovenia or Slovenian Pension System: the mandatory or supplementary pension and invalidity insurance in the Republic of Slovenia, as defined in Article 3 of the ZPPP.
EIB Pension Scheme: the mandatory pension scheme of the EIB.
Insured Person: a person who is or was included in the System of Pension and Invalidity Insurance of the Republic of Slovenia (Slovenian Pension System).
Institute: the Pension and Invalidity Insurance Institute of Slovenia.
ZPPP: the Transfer of Pension Rights Act of 28 April 2010 (ZPPP, Official Gazette of RS, no. 34/2010), setting out the implementation of Regulation (EEC, Euratom, ECSC) No. 259/68 of the Council of 29 February 1968 laying down the Staff Regulations of Officials and the Conditions of Employment of Other Servants of the European Communities and instituting special measures temporarily applicable to officials of the Commission, Official Journal L056, 04/03/1968, as amended.
Article 3:
Procedure upon entry into service at the EIB
(1) A Member of the EIB Pension Scheme, who is an Insured Person may, after having completed five years membership of the EIB Pension Scheme, transfer the Transfer Value acquired within the Slovenian Pension System to the EIB Pension Scheme.
(2) In order to enforce the right referred to in the first paragraph of this Article, the Member shall submit an application for transfer of the Transfer Value to the EIB. The application shall be submitted prior to either
(i) twelve months from the date of the present Agreement entering into force or
(ii) the expiry of a period of twelve months from the completion of five years membership in the EIB Pension Scheme.
(3) EIB shall send notification of the submitted application, in agreed form, to the Institute.
(4) The right to transfer the Transfer Value from the Slovenian Pension System into the EIB Pension Scheme may be enforced only once per current employment of the Member. The application for transfer of the Transfer Value may not be withdrawn from the moment of the Member's acceptance to transfer the rights into the EIB Pension Scheme.
Article 4:
Procedure upon leaving the service of the EIB
(1) A Member of the EIB Pension Scheme, who is an Insured Person may, upon leaving the service of the EIB, transfer the Net Current Value acquired within the EIB Pension Scheme to the Slovenian Pension System.
(2) In order to enforce the right referred to in the first paragraph of this Article, the Member shall submit an application for transfer of the Net Current Value at the EIB. Transfer shall be carried out only at therequest of the Member. The application shall be submitted prior to either
(i) twelve months from the date of the present Agreement entering into force or
(ii) twelve months from the date of termination of employment at the EIB.
(3) EIB shall send a notification, in agreed form, of the submitted application to the Institute.
(4) The right to apply for transfer of the Net Current Value from the EIB Pension Scheme to the Slovenian Pension System may be enforced only once per current employment of the Member. The application for transfer of the Net Current Value may not be withdrawn from the moment of the Member's acceptance to transfer the rights into the Slovenian Pension System.
(5) The EIB shall provide the Institute with all necessary data and certificates required for the calculation of pension rights in the Slovenian Pension System (as shall be made by the Institute in accordance with the ZPPP).
Article 5:
Designated liaison bodies and information
The Institute and EIB shall be obliged as part of their remit to provide general information to the persons concerned regarding their rights and obligations under the present Agreement. In fulfilment of Articles 10 (2), 10 (3) and 15 (2) of the ZPPP, the designated liaison body in the Republic of Slovenia shall be the Institute, and the designated liaison body for the EIB Pension Scheme shall be the EIB. All other necessary measures (by way of forms and other detail concerning the exchange of information required for the implementation) ensuring the technical execution of transfers under this Agreement are agreed or added as an Addendum of Forms, as these are agreed between the Institute and EIB from time to time.
Article 6:
Duration, further application and modification
(1) The present Agreement shall be concluded for an indefinite period. It shall also apply for all cases in which a Member started or terminated his/her employment at the EIB prior to the validity of this Agreement.
(2) Insured Persons who are or have been included as a Member of the EIB Pension Scheme, who have exercised their compulsory pension and disability insurance rights in the Slovenian Pension System prior to the date on which this Agreement entered into force and who, while exercising the aforementioned rights, were not able to transfer the Net Current Value to the Slovenian Pension System, may apply for a renewed assessment of established rights under consideration of transfer of the Net Current Value to the Slovenian Pension System. The application shall be submitted in accordance with the provisions of Article 4 above.
(3) The subsequently assessed rights referred to in the previous paragraph shall be conferred to Insured Persons on the day of transfer of the Net Current Value.
(4) Upon the request of one of the contracting parties, this agreement can be modified in mutual consent between them.
Article 7:
Entry into force, validity, termination
This Agreement shall enter into force the first day of the month following the date of signature hereof by the contracting parties and ratification, and shall remain in force until one of the contracting parties decide to terminate it in writing, taking into account a notice period of one year.
The termination shall come into effect on the first day of the month following the one year period of notice. In the event that this Agreement becomes ineffective through termination, its provisions shall continue to apply in respect of benefits hitherto executed.
This Agreement is drawn up in Luxembourg on 28 June 2012 in four originals in the Slovene and English languages, both texts being equally authentic.
