S P O R A Z U M <br /> MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE HRVAŠKE O SODELOVANJU PRI VAROVANJU PREVOZA GOTOVINE IN DRUGIH VREDNOSTNIH POŠILJK
Vlada Republike Slovenije in Vlada Republike Hrvaške (v nadaljevanju pogodbenici) sta se
na podlagi Sporazuma med Vlado Republike Slovenije in Vlado Republike Hrvaške o čezmejnem policijskem sodelova­nju, podpisanega 6. novembra 2002 v Zagrebu, in
zaradi ureditve razmerij glede varovanja prevoza gotovine in drugih vrednostnih pošiljk (v nadaljevanju prevoz vrednostnih pošiljk) čez državno območje pogodbenic
dogovorili:
Vsaka pogodbenica soglaša, da njeni pristojni organi varujejo prevoz vrednostnih pošiljk za potrebe nacionalne cen­tralne banke druge pogodbenice.
Namen sodelovanja je zagotoviti prevoz vrednostnih po­šiljk čez državni območji pogodbenic.
Pristojna organa za izvajanje tega sporazuma sta:
-
v Republiki Sloveniji: Ministrstvo za notranje zadeve,
-
v Republiki Hrvaški: Ministrstvo za notranje zadeve.
Pogodbenici se po diplomatski poti uradno obvestita o kateri koli spremembi glede pristojnih organov iz prvega od­stavka.
Zaradi izvedbe varovanja prevoza vrednostnih pošiljk pri­stojni organ najpozneje deset dni pred prevozom vrednostnih pošiljk prevoz najavi pristojnemu organu druge pogodbenice.
Najava se opravi s predložitvijo predloga operativnega načrta prevoza vrednostnih pošiljk, ki vsebuje datum, točen čas, mejne prehode vstopa in izstopa ter število načrtovanih prevozov.
Predlog operativnega načrta prevoza vrednostnih pošiljk vsebuje tudi te podatke:
-
odgovorne osebe pristojnih organov;
-
številke mobilnih telefonov odgovornih oseb pristojnih organov;
-
tip in registrsko številko oklepnih ali drugih vozil in spre­mljevalnih vozil;
-
uslužbence, ki bodo sodelovali pri prevozu;
-
datum, predvideni čas in mejni prehod vstopa na držav­no območje druge pogodbenice;
-
datum, predvideni čas in mejni prehod izstopa z držav­nega območja druge pogodbenice.
Pristojna organa sodelujeta pri uskladitvi operativnega načrta prevoza vrednostnih pošiljk, ki mora biti pripravljen pet dni pred prevozom.
Vsa tehnična vprašanja v zvezi z izvajanjem tega spora­zuma se rešujejo prek odgovornih oseb pristojnih organov; te so določene v operativnem načrtu prevoza vrednostih pošiljk in so ves čas dosegljive za pristojne organe druge pogodbenice.
O morebitnih spremembah glede odgovornih oseb in nji­hovih podatkov za stike se pristojna organa pisno obveščata vnaprej, najpozneje pa takrat, ko pride do spremembe.
Pogodbenici opravita prevoz vrednostnih pošiljk z okle­pnimi ali drugimi vozili. Prevoz vrednostnih pošiljk spremljajo predstavniki pogodbenic.
Varovanje prevoza vrednostnih pošiljk zagotovi policija, pri čemer se ravna po splošno priznanih standardih za varova­nje prevozov vrednostnih pošiljk.
Za morebitno škodo, ki jo utrpijo uslužbenci ali nastane na prevoznih sredstvih, se uporabljajo enaka pravila, kot jih določa Sporazum med Vlado Republike Slovenije in Vlado Republike Hrvaške o čezmejnem policijskem sodelovanju.
Pogodbenici se zavezujeta, da bosta vse podatke v zvezi s prevozom vrednostnih pošiljk označili s stopnjo tajnosti ter varovali v skladu s svojo notranjo zakonodajo in veljavnimi mednarodnimi pogodbami.
Pogodbenica, ki opravlja prevoz vrednostnih pošiljk v skladu z določbami tega sporazuma, krije stroške, ki jih ima druga pogodbenica zaradi zagotavljanja storitve varovanja pre­voza čez svoje državno območje, po veljavnem ceniku blaga in storitev ter v skladu z osnovo za izračun - stroškovnikom.
Stroški prevoza iz prvega odstavka se zaračunajo po vsakem opravljenem prevozu vrednostnih pošiljk.
Pogodbenici se o načinu in roku plačila ter ceniku blaga in storitev obvestita z izmenjavo pisem.
Ob zamudi pri plačilu lahko pogodbenica, čez državno ob­močje katere se je opravil prevoz vrednostnih pošiljk, zaračuna zamudne obresti v skladu s svojo notranjo zakonodajo.
Ta sporazum se lahko kadar koli spremeni s pisnim so­glasjem pogodbenic.
Spremembe začnejo veljati v skladu s prvim odstavkom 10. člena tega sporazuma.
Morebitni spori zaradi razlage ali uporabe tega sporazu­ma se rešujejo s posvetovanji med pristojnima organoma.
Če spora ni mogoče rešiti s posvetovanji, se rešuje po diplomatski poti.
Ta sporazum se sklene za nedoločen čas.
Vsaka pogodbenica lahko ta sporazum kadar koli pisno odpove po diplomatski poti. V tem primeru sporazum preneha veljati šest (6) mesecev od datuma, ko je druga pogodbenica prejela obvestilo o odpovedi.
Če katera koli pogodbenica krši določbe tega sporazuma, lahko druga pogodbenica sporazum odpove trideset dni (30) vnaprej s pisnim uradnim obvestilom po diplomatski poti.
Vsaka pogodbenica lahko delno ali v celoti začasno pre­kine uporabo tega sporazuma zaradi javne varnosti ali javnega reda. O začasni prekinitvi uporabe tega sporazuma oziroma o preklicu začasne prekinitve se druga pogodbenica nemudoma pisno uradno obvesti po diplomatski poti.
Ta sporazum začne veljati trideseti dan po datumu preje­ma zadnjega pisnega uradnega obvestila, s katerim se pogod­benici po diplomatski poti obvestita, da so končani notranje­pravni postopki, potrebni za začetek njegove veljavnosti.
Z dnem začetka veljavnosti tega sporazuma prenehajo veljati vsi obstoječi dogovori o prevozu vrednostnih pošiljk med pogodbenicama.
Sestavljeno v Valbandonu dne 15. junija 2011 v dveh iz­virnikih v slovenskem, hrvaškem in angleškem jeziku, pri čemer so vsa besedila enako verodostojna. Ob razlikah pri razlagi prevlada angleško besedilo.

AGREEMENT <br /> BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE REPUBLIC OF CROATIA ON COOPERATION IN THE PROTECTION OF THE TRANSPORT OF CASH AND OTHER VALUABLES

The Government of the Republic of Slovenia and the Government of the Republic of Croatia, (hereinafter referred to as "the Contracting Parties"),

with regard to the Agreement between the Government of the Republic of Slovenia and the Government of the Republic of Croatia on Cross-border Police Cooperation, signed on 6 November 2002 in Zagreb, and

with a view to regulating the relations regarding the protection of the transport of cash and other valuables (hereinafter referred to as "the transport of valuables") across the territories of the Contracting Parties,

have agreed as follows:

I PURPOSE

Article 1

Each Contracting Party agrees that its competent authorities shall protect the transport of valuables for the needs of the National Central Bank of the other Contracting Party.

The purpose of cooperation is to ensure the transport of valuables across the territories of the Contracting Parties.

II COMPETENT AUTHORITIES

Article 2

The competent authorities for the implementation of this Agreement are:

– in the Republic of Slovenia: Ministry of the Interior;

– in the Republic of Croatia: Ministry of the Interior.

The Contracting Parties shall notify each other through diplomatic channels of any changes regarding the competent authorities specified in paragraph 1.

III PROCEDURE

Article 3

With a view to carrying out the protection of the transport of valuables, the competent authority shall announce the transport of valuables to the competent authority of the other Contracting Party ten days before the transport of valuables is carried out at the latest.

The announcement shall be done by submitting a proposed operational plan of the transport of valuables including the date, exact time, border crossing points of entry and exit and the number of transports planned.

The proposed operational plan of the transport of valuables shall also contain the following data:

– responsible persons of the competent authorities;

– mobile phone numbers of responsible persons of the competent authorities;

– type and registration number of armoured or other vehicles and escort vehicles;

– staff taking part in transport;

– date, estimated time and border crossing point of entry into the territory of the other Contracting Party;

– date, estimated time and border crossing point of exit from the territory of the other Contracting Party.

The competent authorities shall work together in coordinating the operational plan of the transport of valuables, which needs to be completed five days before the transport.

Any technical issues arising from the implementation of this Agreement shall be addressed through responsible persons of the competent authorities; they shall be nominated in the operational plan of the transport of valuables and are contactable by the competent authorities of the other Contracting Party at all times.

The competent authorities shall inform each other in writing of any changes in connection with the responsible persons and their contact details in advance or when a change occurs at the latest.

Article 4

The Contracting Parties shall carry out the transport of valuables with armoured or other vehicles. The transport of valuables shall be escorted by the representatives of the Contracting Parties.

The police shall provide protection of the transport of valuables and, in doing so, shall comply with the generally recognised standards for the protection of transports of valuables.

For any damage to the staff or transport means the same rules shall apply as are defined in the Agreement between the Government of the Republic of Slovenia and the Government of the Republic of Croatia on Cross-border Police Cooperation.

IV COMMUNICATION BETWEEN THE CONTRACTING

PARTIES

Article 5

The Contracting Parties shall undertake to classify and protect all the data relating to the transport of valuables in accordance with their national legislation and the applicable

international treaties.

V COSTS

Article 6

The Contracting Party carrying out the transport of valuables in line with the provisions of this Agreement shall cover costs incurred to the other Contracting Party while providing the service of transport protection across its territory in line with its applicable pricelist for commodities and services and in conformity with the basis for calculation – bill of costs.

The transport fee from paragraph 1 shall be charged after each transport of valuables provided.

The Contracting Parties shall inform each other of the method, period of payment and pricelist for commodities and services by exchanging letters.

In the event of late payment the Contracting Party across whose territory the transport of valuables has been carried out has the right to charge interest in line with its national legislation.

VI FINAL PROVISIONS

Article 7

This Agreement may be amended at any time by mutual written consent of the Contracting Parties.

Such amendments shall enter into force in accordance with Article 10, paragraph 1 of this Agreement.

Article 8

Any dispute arising out of interpretation or application of this Agreement shall be settled by consultations between the competent authorities.

If the dispute cannot be settled through consultations, it shall be settled through diplomatic channels.

Article 9

This Agreement is concluded for an indefinite period of time.

Each Contracting Party may at any time terminate this Agreement in writing through diplomatic channels. In such a case, the Agreement shall terminate six (6) months from the date on which the notice of termination was received by the other Contracting Party.

If either Contracting Party violates the provisions of this Agreement, the other Contracting Party shall have the right to terminate this Agreement by written notification through diplomatic channels thirty (30) days in advance.

Either Contracting Party may partially or entirely suspend the application of this Agreement for reasons of public security or public order. Such suspension of the Agreement, or the cessation of the suspension, shall be immediately notified to the other Contracting Party in writing through diplomatic channels.

Article 10

This Agreement shall enter into force on the thirtieth day following the date of the receipt of the last written notification by which the Contracting Parties have informed each other through diplomatic channels of the completion of their internal legal procedures necessary for the entry into force of this Agreement.

As of the date of entry into force of this Agreement, all existing arrangements relating to the transport of valuables between the Contracting Parties shall cease to apply.

Done at Valbandon on 15 June 2011 in two originals, each in the Slovenian, Croatian and English languages, all texts being equally authentic. In case of divergence in interpretation, the English text shall prevail.
