S K L E P
o potrditvi Programa mednarodnega razvojnega sodelovanja med Vlado Republike Slovenije in Vlado Črne gore za obdobje 2018–2019

1. člen

Potrdi se Program mednarodnega razvojnega sodelovanja med Vlado Republike Slovenije in Vlado Črne gore za obdobje 2018–2019, sklenjen v Ljubljani 23. novembra 2018.

2. člen

Program se v izvirniku v angleškem jeziku in prevodu v slovenskem jeziku glasi:
PROGRAMME OF DEVELOPMENT COOPERATION BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF MONTENEGRO FOR THE PERIOD 2018–2019
The Republic of Slovenia and Montenegro (hereinafter: “the Parties”),
Based on the Agreement on Development Cooperation between the Government of the Republic of Slovenia and the Government of Montenegro, signed on 7 February 2008,
Have agreed on the following:

I FUNDS EARMARKED FOR BILATERAL DEVELOPMENT COOPERATION BETWEEN THE REPUBLIC OF SLOVENIA AND MONTENEGRO FOR THE PERIOD 2018–2019

Article 1

The Government of the Republic of Slovenia has earmarked funds in the total amount of EUR 1.848,049 for bilateral development cooperation between the Republic of Slovenia and Montenegro in the period 2018–2019 in the Budget of the Republic of Slovenia for 2018 and the Budget of the Republic of Slovenia for 2019.

II DEVELOPMENT PROJECTS AIMED AT ENHANCING ECONOMIC AND SOCIAL INFRASTRUCTURE

Article 2

1.

The Government of the Republic of Slovenia has earmarked funds in the approximate amount of EUR 1,344,177 for the period 2018–2019 in support of development projects aimed at enhancing economic and social infrastructure in Montenegro.

2.

When selecting projects aimed at enhancing economic and social infrastructure, the Parties took into account the strategic priorities of Montenegro, which focus on sustainable development, ecology and environmental protection, with a special emphasis on the least developed parts of Montenegro.

3.

In the period 2018–2019, the Parties plan to undertake the following new projects in the field of economic and social infrastructure:
1 Construction of a plant-based waste water treatment plant in Petnjica
2 Construction of a plant-based waste water treatment plant in Andrijevica
3 Construction of a transfer station for mixed municipal waste in Cetinje 
4. If any of the projects listed in paragraph 3 of this Article are not implemented and if the conditions for including additional projects are met, the Parties shall agree to add other projects to the list, which shall be agreed upon by the Parties in an Annex to this Agreement.

Article 3

1.

For projects aimed at enhancing economic and social infrastructure, the share of co-funding provided by the Republic of Slovenia shall generally not exceed 50% of the total value. The remaining funds shall be ensured by the relevant legal entity in the recipient country.

2.

Any changes to the co-funding share must be authorised by the Ministry of Foreign Affairs of the Republic of Slovenia on a case-by-case basis.

3.

The recipient country shall decide at its own discretion on how to complete the financial construction of a project.

Article 4

The recipient country shall select a contractor in accordance with its national legislation regulating public finances and public procurement. In special cases, when the Republic of Slovenia provides the majority of co-funding, the Centre for International Cooperation and Development, in agreement with the donation recipient, shall select a contractor on the basis of a call for applications published in the Republic of Slovenia in accordance with the Slovenian legislation governing public finances and public procurement.

III TECHNICAL ASSISTANCE

Article 5

The Parties have agreed to provide funds in the approximate amount of EUR 503,872 for technical assistance.
