POVZETEK
Prispevek obravnava amandma v pojavni obliki, kot je prisoten v zakonodajnem postopku v ožjem smislu, torej le v Državnem zboru Republike Slovenije. Predstavljeni sta normativna ureditev, ki je zajeta v Poslovniku državnega zbora, in parlamentarna praksa postopanja z amandmajem, pri čemer so izpostavljene težave in nepravilnosti oziroma zlorabe, ki se pri tem pojavljajo. Za primerjavo so prikazani prejšnja poslovniška ureditev in njen dosedanji razvoj glede amandmajev kot tudi nekatere tuje ureditve glede na način oblikovanja in ravnanja z amandmaji, ki odstopa od slovenske danosti. Prispevek je kritičen do odnosa Vlade Republike Slovenije tako pri oblikovanju zakonskih predlogov kot – posledično in samostojno – amandmajev ter nasprotuje paradigmi o predlogu zakona, ki z vložitvijo v zakonodajno proceduro postane last parlamenta. Ta fikcija naj bi namreč vlado odvezala odgovornosti za pripravo kvalitetne zakonodaje. Glede na število vloženih oziroma sprejetih amandmajev, potek zakonodajnega postopka v odvisnosti od vloženih amandmajev, široke možnosti zlorab amandmaja, predvsem pa glede na dejstvo, da se amandma prelije v zakonsko določbo in z njim deli usodo, je nenavadno, da ga niti znanost niti stroka ne problematizirata. V prispevku je poleg kritike poudarek tudi na idejah za spremembo parlamentarne prakse, če že ne poslovniške ureditve, pri čemer se prikazana znanstvena izhodišča in normativna ureditev prepletajo z avtoričinimi empiričnimi spoznanji.
SUMMARY
The article discusses amendments as they appear in the legislative procedure in the strict sense, i.e. in the National Assembly of the Republic of Slovenia. It presents their regulation in the Rules of Procedure of the National Assembly as well as the relevant parliamentary practice, with an emphasis on the problems and irregularities, as well as possible abuses. A comparison is made between the regulation of amendments under the previous Rules of Procedure and its hitherto development, as well as with selected foreign countries, focusing on the differences in formulating and dealing with amendments. The article is critical of the attitude of the Slovenian Government toward drafting legislative proposals and – consequently or independently – amendments, and opposes the paradigm whereby a draft law becomes property of the Parliament after having been submitted into legislative procedure. Such fiction would in fact release the Government from its accountability to draft quality legislation. Considering the number of amendments tabled or adopted, the course of the legislative procedure depending on the amendments tabled, the wide scope of possible abuses of amendments, and, above all, the fact that amendments translate into legal provisions and share their fate, it is unusual that neither scientists nor professionals see them as problematic. The article suggests ideas for changing the parliamentary practice, if not the regulation provided by the Rules of Procedure itself, intertwining scientific bases and regulatory arrangements with the empirical findings of the author.
