Avtor analizira pravno ureditev učinkovanja odločb Ustavnega sodišča na pravna razmerja, ki so nastala pred objavo odločbe, z vidika načel zaupanja v pravo in prepovedi retroaktivnosti. Razveljavitev zakona namreč učinkuje tudi na vsa razmerja, nastala pred dnem, ko je razveljavitev začela učinkovati, če o njih še ni bilo pravnomočno odločeno. Pri tem si avtor prizadeva najprej natančno opredeliti trenutek nastanka nekega pravnega razmerja, v nadaljevanju pa predstavi argumente, ki kažejo na to, da v nekaterih primerih odločbe Ustavnega sodišča učinkujejo za nazaj oziroma vsaj posegajo v načelo zaupanja v pravo. Predstavi tudi nekaj primerov, ki to problematiko ponazarjajo, nato pa se opredeli do nekaterih argumentov v korist obstoječi ureditvi. Na koncu predstavi še možne rešitve za navedeno problematiko in ureditev tega področja v nekaterih drugih evropskih državah ter pred Sodiščem Evropske unije in Evropskim sodiščem za človekove pravice.

The author analyses the regulation of effects that a Constitutional Court’s decision has on legal relations, which began before the publication of the decision, from the perspective of principles of legitimate expectations and non­retroactivity. Rescission of an act must be applied to all the relations, which began before the day, when the rescission entered into force, if they were not concluded with the force of res judicata. The author firstly tries to define precisely the moment when a legal relation begins and then puts forward arguments for the thesis that sometimes the Constitutional Court’s decisions have retroactive effect or at least encroach upon legitimate expectations principle. This is followed by presentation and analysis of the current case law on this matter and then assessment of arguments in favour of the current approach. Lastly, the author puts forward possible solutions for stated issues and presents the approaches to these problems in some other European countries and before the Court of justice of European Union and the European Court of Human Rights.
