POVZETEK
V Evropski uniji je Uredba Bruselj I najpomembnejši akt, ki ureja sporazume o mednarodni pristojnosti. Avtorica analizira določbe uredbe in sodno prakso Sodišča Evropske unije in nacionalnih sodišč ter išče rešitve za še nerešene probleme, ki so se ali bi se lahko pojavili v praksi. Tako obravnava pogoje za dopustnost prorogacije, pravo, ki ga je treba uporabiti za presojo dopustnosti in veljavnosti prorogacije, privolitev toženca v pristojnost kot obliko prorogacije, predmet prorogacijskega sporazuma itd. Posebno pozornost namenja tudi učinkovanju sporazuma v kompleksnejših pravnih razmerjih, na primer ob sodelovanju tretjih oseb, v primeru povezanih tožb in litispendence, pa tudi takrat, ko bi upoštevanje sporazuma privedlo do neželenih rezultatov. Prispevek sklene z obravnavo določb uredbe o priznanju in izvršitvi sodnih odločb, izdanih na podlagi sporazuma o pristojnosti.
SUMMARY
The choice-of-court agreements in private international law represent a departure from the rules on international jurisdiction contained in national and international legal acts. The most important of such acts in the European Union is the Brussels I Regulation. The author analyses the provisions of the regulation and the case-law of the Court of Justice of the European Union, as well as of the national courts. She searches solutions for the problems yet unsolved, which have or could arise in courts. She deals with the conditions for admissibility and validity of the agreements, the applicable law, the jurisdiction based on the defendant’s appearance, the object of the agreement etc. Special attention is drawn to the effects of the agreements in more complex legal relationships, such as the participation of third parties, the lis pendens and the related actions, as well as the situations where upholding the agreement would lead to unwelcome results. The paper is concluded by the analysis of the recognition and enforcement of judgments delivered on the basis of a choice-of-court agreement, which is also regulated by the Brussels I Regulation.
