POVZETEK
Članek obsega pravno-ekonomsko analizo aktualne ureditve in prakse kadrovanja na slovenskih javnih visokošolskih zavodih. V članku so identificirane številne možnosti pravno-ekonomsko neutemeljenega zoževanja kroga potencialnih kandidatov za zasedbo posameznih delovnih mest: potencialne zlorabe oz. ekonomsko neracionalne zahteve v zvezi s habilitacijskimi nazivi in doseženo stopnjo izobrazbe, zelo kratko trajanje določenih razpisov, splošna praksa zaposlovanja neposredno za nedoločen in poln delovni čas, neuporaba pravnih možnosti glede uvajanja novozaposlenih kandidatov, ter potencialno nesorazmerne zahteve po uporabi slovenskega jezika v našem visokošolskem prostoru – vsi ti kazalci nakazujejo na neučinkovitosti aktualne ureditve in prakse kadrovanja. Pregled kadrovskih razpisov slovenskih javnih visokošolskih zavodov nadalje razkriva, da v njih ne obstaja enotna praksa pri postavljanju pogojev niti znotraj univerze, niti znotraj posameznih fakultet, zaradi česar lahko, izhajajoč iz ugotovitev o še vedno v veliki meri planski ureditvi trga visokega šolstva v Sloveniji, domnevamo na široko polje diskrecije visokošolskih elit (posameznih kateder, profesorjev?) pri kadrovanju.
SUMMARY
This paper analyses current regulation of employment procedures as well as employment practices at Slovenian public universities from legal and economic points of view. It identifies multiple possibilities for inefficient narrowing down of the circle of potential candidates for teaching and research positions: from potentially arbitrary use of academic titles in application procedures to very short application time in some cases, from generally performed practice of employing candidates full time as well as for an unlimited period of time to the practice of employing them without using legal possibilities of trial period and internships, as well as to the very likely disproportionate request regarding obligatory use of Slovenian language in publicly funded tertiary education in the country - all these aspects arise reasonable doubt about legal and economic efficiency of current regulation and practices in the field. Moreover, in the paper, it is also shown, that there is no common practice neither among Slovenian public universities nor within them (among their faculties) regarding employment procedures, which, based on findings that the Slovenian market for higher education is still to great extent subject to planning, leads us to assumption, that the system allows university elites (single professors, departments of faculties?) a wide field of discretion in hiring, which can present a great threat to future competitiveness of Slovenian public universities due to their monopolistic position in the market.
