POVZETEK
Odgovornost predstojnikov organov javne uprave za napake, do katerih pride v okviru upravnih postopkov in pri izdajanju upravnih odločb, je povezana z ureditvijo pooblastila za vodenje postopka in odločanje o upravnih zadevah. O upravnih zadevah ne odločajo le predstojniki, temveč pooblastilo pogosto delegirajo na svoje sodelavce – uradne osebe v organu. Kadar predstojnik sam izda odločbo, je tudi neposredno odgovoren zanjo. Kadar pa odločbo izda druga uradna oseba po njegovem pooblastilu, predstojnik ne odgovarja za to odločbo ne kazensko ne odškodninsko. Prav tako ne more (krivdno) odgovarjati zaradi kršitve delovnih obveznostih. Lahko pa (objektivno) odgovarja za napake drugih v skladu s četrtim in petim odstavkom 159. člena Zakona o javnih uslužbencih – gre za odgovornost za rezultate dela organa oziroma organizacijske enote, ki jo vodi; v primeru, da se ne ekskulpira (to pa lahko stori tako, da dokaže, da je s skrbnostjo dobrega strokovnjaka storil vse, kar je bilo v njegovi pristojnosti, da bi preprečil, odpravil oziroma odvrnil slabo delovanje oziroma napake), je lahko premeščen ali pa se mu odpove delovno razmerje zaradi nedoseganja pričakovanih delovnih rezultatov.
SUMMARY
Responsibility of heads of public administration bodies for the mistakes that occur in the context of administrative decision-making, is associated with the regulation of the authorisation to conduct proceedings and decide on administrative matters. The administrative matters are not only decided on by the heads; quite often the heads – according to the General Administrative Procedure Act - deleguate authority to other officials employed within the body. When a decision is taken (signed) by the head himself, he or she is also directly responsible for it. However, when a decision is taken (signed) by another official under deleguation of authority by the head, the head is not subjectively responsible for this decision in terms of criminal responsibility or responsibility for eventual damages, nor can he or she be held responsible for breach of job responsibilities. However the head can be held (objectively) responsible for others' mistakes, in accordance with Article 159, Para. 4 and 5 of the Law on Public Servants. It is a kind of responsibility for the results of work of the organization or orgaizational unit that he or she manages. The responsibility does not take place in case the head exculpates himself/herself by demonstrating that he or she did everything it was in his/her power to prevent, deter and eliminate poor performance or failure, acting with due diligence. If the head can be held responsible, he or she can be removed from the managerial position or even fired for not reaching the expected business results
