POVZETEK
Prispevek obravnava problematiko prevajanja pravnih aktov samoupravnih lokalnih skupnosti na izbranem dvojezičnem območju v Sloveniji in Italiji. Tematika je obravnavana tako normativno kot empirično. Uporabljene so deskriptivna, komparativna in empirična metoda (anketa). Poudarek prispevka je na empirični raziskavi, izvedeni med prevajalci in pravniki iz izbranih uprav samoupravnih lokalnih skupnosti v Sloveniji in Italiji. Raziskava ima več ciljev, in sicer ugotoviti, kako problematiko dvojezičnega poslovanja dojemajo neposredni akterji, torej prevajalci in pravniki, zaposleni v občinskih upravah, na tej podlagi sprožiti razpravo o problemu pravilnega in kakovostnega prevajanja na dvojezičnem območju ter s tem prispevati k izboljšanju poslovanja organov samoupravnih lokalnih skupnosti v Sloveniji in Italiji. Avtorja postavita tri hipoteze, pri čemer potrdita hipotezo, da prevajalci samoupravnih lokalnih skupnosti slabo poznajo pravni sistem obeh držav, delno potrdita hipotezo, da prevajalci ne poznajo konceptualnih razlik pravne ureditve obeh državin zavrneta hipotezo, da bi bilo primerno v prevajalskih službah zaposlovati tudi kader s pravno izobrazbo. Za izboljšanje kakovosti pravnega prevajanja namesto tega predlagata druge rešitve, npr. čezmejno sodelovanje, delavnice in študijsko prakso v okviru univerzitetnega izobraževanja.
SUMMARY
This paper deals with the problem of translating legal acts of local communities in the selected bilingual area in Slovenia and Italy. The topic is treated normatively and empirically. We used descriptive, comparative and empirical method (poll). The focus of this paper is on empirical research conducted among translators and lawyers from selected local authorities in Slovenia and Italy. The study has several objectives, namely to determine how the problem of bilingual perceive direct actors, i.e. translators and lawyers employed in municipal administration, on this basis to start a discussion about the problem of accurate and high-quality translation in a bilingual area, and thereby contribute to improving the performance of self-governing bodies local communities in Slovenia and Italy. The authors placed three hypotheses. The hypothesis that the translators of local communities have poor knowledge of the legal system of both countries was confirmed, the hypothesis that translators do not know the conceptual differences in the legal regulation of both states was partly confirmed and the hypothesis that it would be appropriate to employ staff with legal education in translation services was not confirmed. In order to improve the quality of legal translation authors instead propose other solutions e.g. cross-border cooperation, workshops and teaching practice in the context of university education.
