I am here to introduce you to “Presentation of Evidence in Arbitration Proceedings”, but before proceeding to do so I must make a disclaimer: Ultimately there is no standard approach to presenting evidence in international arbitration. Parties turn to arbitration for a number of reasons but flexibility is often cited as the most desirable benefit of international arbitration. The parties and tribunal, working together, have the ability and incentive to craft tailor-made approaches with regard to presenting evidence. That is not to say that the parties and the tribunal in each international arbitration must reinvent the wheel. This is certainly not the case as some of the world's brightest and most creative legal minds have developed certain internationally accepted/able practices and approaches to the presentation of evidence, which I discuss below.
