POVZETEK
Postopek izbire koncesionarja v Zakonu o nekaterih koncesijskih pogodbah
(ZNKP) sledi primerljivemu poglavju Direktive EU o koncesijah. Postopek
podelitve koncesije lahko v praksi razumemo ob smiselni uporabi institutov
odprtega postopka, toda hkrati zavedajoč se, da gre za postopek, ki naj bo
bistveno manj formaliziran, kot je postopek javnega naročila. Podobno stališče
glede postopka podelitve koncesije – tako imenovano stališče o prednosti preglednosti
pred formalnostjo – je sicer zavzelo že Sodišče EU v zadevi Comune
di Ancona proti Regione Marche leta 2013. Zato je tudi glede obveznega zagotavljanja
preglednosti treba ugotoviti, da je ureditev v ZNKP na tem področju,
vsaj glede faze oddaje koncesije, prožnejša od ureditve v pravilih o javnem
naročanju.
SUMMARY
The procedure for selecting the concessionaire in Slovenian Certain Concession
Contracts Act follows a comparatively conceptual chapter in the EU
Concessions Directive. In practice, the procedure for granting a concession can
be understood in a meaningful application of the (public procurement) open
procedure, but at the same time one has to be aware that it is considerably
less formalised procedure than a public procurement procedure. A similar position
on the concession award procedure, e.g. on the preference of transparency
before formalities, has already been taken up by the EU Court of Justice
in case Comune di Ancona v Regione Marche in 2013. Therefore, with regard to
mandatory transparency, it should be noted that the regulation in the Certain
Concession Contracts Act in this area, at least in terms of the concession award
phase, is more flexible than the regulation in the rules on public procurement.
