POVZETEK
Prispevek analizira pravila prava EU, kot jih določata Pogodba o delovanju EU in sodna praksa Sodišča EU na področju pogoja državljanstva za zaposlovanje v javnem sektorju in pojasnjuje, kdaj lahko države članice izvajajo kadrovski protekcionizem v javnem sektorju in kdaj ne. Avtorica ugotavlja, da funkcionalni pristop k presoji izjem javne službe in javne oblasti, ki zahteva presojo poklicev od primera do primera, v praksi omogoča ohranjanje številnih nepo-trebnih pridržkov državljanstva. Njihova odprava je tako vezana na prioritete Komisije in zagnanost posameznikov, ki so od določene zaposlitve zavrnjeni zgolj zaradi državljanstva. Po drugi strani bi ta odprava nesorazmerno prizadela države članice, katerih jezik govori veliko državljanov EU, v primerjavi s tistimi, kjer je pogoj jezika praktično izenačen z zahtevo po državljanstvu.
SUMMARY
The article analyses EU law provisions, determined by the Treaty on Functioning of the EU and by the jurisprudence of the EU Court of Justice in relation to the nationality condition for public sector employments and explains, when may EU Member States perform human resource protectionism in the public sector and when not. The author ascertains that functional approach to public service and public authority exceptions, which requires a case by case approach, in practice enables preservation of numerous unnecessary nationality conditions. Their abolition is hence dependent upon the priorities of the Commission and efforts of individuals, whose access to employment is rejected solely by reason of their nationality. On the other hand, this abolition would disproportionally affect EU Member States with national languages spoken by many EU citizens, as opposed to those, where language requirement is practically identical to the nationality requirement.
