POVZETEK
Prispevek obravnava vpliv, ki ga ima uveljavitev novega Zakona o nekaterih
koncesijskih pogodbah (ZNKP) na področju gospodarskih javnih služb. V
prvem delu avtorica ugotavlja, ali se ZNKP na področju gospodarskih javnih
služb sploh uporablja, kakšno je razmerje med ZNKP in Zakonom o gospodarskih
javnih službah (ZGJS) ter Zakonom o javno-zasebnem partnerstvu (ZJZP),
v nadaljevanju pa predstavi postopek podeljevanja koncesij, kot bi moral veljati
od uveljavitve ZNKP dalje, ter nekatera druga vprašanja, ki jih nova pravna
ureditev odpira.
SUMMARY
The article discusses the impact of implementation of the new Slovenian Act
on Certain Concession Contracts (ZNKP) in the field of services of general economic
interest. In the first part, the author assesses whether the ZNKP is at all
applicable in the field of services of general economic interest as well as focuses
on the ratio between the Services of General Economic Interest Act (ZGJS)
and the Public-Private Partnership Act (ZJZP). In continuation, the author presents
the procedure of granting concessions, as it should apply from the entry
into force of the ZNKP, and some other issues raised by the new legislation.
