Avtor razpravlja o pravnoformalnih vidikih priprave predpisa, ki poleg nomotehnike v ožjem pomenu zajema še nekatere druge prvine, ki so pomembne za pravno pravilno pripravo predpisa. Gre zlasti za izbiro ustrezne vrste predpisa, za zahtevo po njegovi skladnosti s predpisi višje ravni v hierarhiji pravnih predpisov ter za zahtevo po njegovi skladnosti s predpisi iste ravni. Merilo za izbiro je vsebina družbenega razmerja, ki ga je treba urediti s splošnim pravnim aktom. Izbrani predpis mora biti pravno pravilen, torej na pravilen način umeščen v pravni sistem, kar pomeni, da mora izhajati iz višjega predpisa in biti vsebinsko z njim v skladu, biti pa mora tudi v skladu s predpisi iste ravni. Vse povedano je nujen pogoj za zagotavljanje koherentnosti pravnega reda.

The author discusses legal aspects of preparing a legal regulation, that besides nomotechnics in the narrow sense includes also some other elements, that are important for legally correct drafting a regulation. It concerns especially proper form of the regulation, accordance with higher level regulations and accordance with regulations of the same level. The criteria for the choice is the content of the social relation that has to be regulated. The chosen form of legal act has to be legally correct, that means it must be properly located in the legal system. Thus it has to derive from the higher regulation and its content has to be in accordance with such regulation and also with regulations of the same level. All this represents essential condition of the realisation of coherence of legal order.
