POVZETEK
Policija je kot organ izvršilne oblasti v največji meri pristojna za zagotavljanje javne varnosti in vzdrževanja javnega reda in miru ter hkrati eden od ključnih nosilcev, ki skrbijo za delovanje kazenskopravnega sistema v Republiki Sloveniji. Poleg tega je policija eden od ključnih dejavnikov pri zagotavljanju nacionalne varnosti, pri čemer tesno sodeluje z drugimi varnostnimi organi. Slovenska policija se je v letu 2009 lotila prenove policijske zakonodaje in posledica tega sta bila dva nova zakona – Zakon o organiziranosti in delu v policiji in Zakon o nalogah in pooblastilih policije, ki sta izšla v letu 2013. Smoter prenove policijske zakonodaje je bil predvsem v tem, da se je obsežno tematiko zapisalo na jasnejši, preglednejši in bolj sistematičen način. Prav tako je v novih zakonih večji poudarek na zaščiti svobode in spoštovanju temeljnih človekovih pravic in svoboščin. Sicer pa se organiziranost, temeljne naloge in pooblastila policije s sprejemom novih zakonov niso bistveno spremenila. Poleg policije je del izvršilne veje oblasti tudi Uprava za izvrševanje kazenskih sankcij (UIKS), ki v Republiki Sloveniji izvršuje kazenske sankcije kot organ v sestavi ministrstva, pristojnega za pravosodje. Kazni zapora in mladoletniškega zapora ter kazni zapora, izrečene po drugih predpisih, se izvršujejo v zavodih, ki so dislocirane notranje organizacijske enote uprave.
ABSTRACT / SUMMARY
As a part of the executive authority, the police is largely responsible for ensuring public safety and the maintenance of law and order and at the same time one of the key actors, who are responsible for the functioning of the criminal justice system in the Republic of Slovenia. In addition, the police is one of the key factors in ensuring national security, while working closely with other law enforcement authorities. In 2009, the Slovenian police embarked on reforming the police legislation and the result were two new laws – Organization and work of the police act and Police tasks and powers act, which were released in 2013. The aim of the renovation of the police legislation was mainly that this extensive topic would be written in a clearer, more transparent and systematic manner. Moreover, a greater emphasis on the protection of freedom and respect for fundamental human rights and freedom is put on in the new laws. Otherwise, the organization, the basic functions and powers of the police, enacting new laws, have not changed significantly.The Prison Administration of the Republic of Slovenia, like police a part of the executive authority, implements criminal penalties as a body within the Ministry of Justice. Prison sentences and juvenile prison and prison sentences, handed down by other regulations, are enforced in institutions that are dislocated internal organisational units of the Administration.
