POVZETEK
Z razvojem pravnega normiranja se ob uvedbi nove zakonodaje pojavi potreba po urejanju primerov, ki so nastali pod do tedaj veljavnimi pravili in ob prehodu še niso zaključeni. Temu so namenjene prehodne določbe, med katere zakonodajalec pogosto nomotehnično nepravilno vključuje materialne določbe, ki niso prehodne narave in ne spadajo tja. Med prehodnimi določbami se nepravilno urejajo različne vrste materialnih določb. Nekatere so vezane na začasne, interventne ukrepe, druge so vezane na noveliranje drugih zakonov. V prispevku so predstavljeni konkretni primeri obeh navedenih vrst materialnih določb, ki jih zakonodajalec nekonsistentno ureja med prehodnimi določbami. Kljub opozorilom pravne stroke, da gre pri takšnem načinu urejanja za kršitev načela pravne države iz 2. člena Ustave, se takšna praksa zakonodajalca nadaljuje in celo razširja. Namen tega prispevka je preučiti ureditev materialnih določb v slovenski zakonodaji, analizirati primere zakonodajnih nepravilnosti, raziskati razloge za tovrstno normiranje ter poudariti pravne in ustavne posledice, ki jih takšne nepravilnosti prinašajo.
SUMMARY
With the development of legal regulation, the introduction of new legislation brings a need to address cases that arose under previously applicable rules and remain unresolved at the time of the transition. Transitional provisions serve this purpose, but legislators often incorrectly include substantive provisions–provisions that are not transitional by nature–within them. Various types of substantive provisions are improperly regulated within the transitional provisions. Some pertain to temporary, emergency measures, while others relate to amendments to other laws. This article presents specific examples of both types of substantive provisions that are inconsistently regulated among the transitional provisions. Despite warnings from legal experts that this approach violates the principle of the rule of law, enshrined in Article 2 of the Constitution, such legislative practices persist and are even expanding. The aim of this article is to examine the regulation of substantive provisions in Slovenian legislation, analyze cases of legislative irregularities, investigate the reasons behind this type of regulation, and highlight the legal and constitutional consequences that such irregularities bring.
