Labour law issues of teleworking and arrangement of working relations in covid conditions
POVZETEK
Izbruh epidemije koronavirusne bolezni je delodajalcem v zasebnem in javnem sektorju prinesel številne izzive, pa ne le
na področju zagotavljanja likvidnosti, temveč tudi pri organizaciji delovnega procesa in urejanju delovnopravnih razmerij z zaposlenimi.
Ob prvem valu izbruha epidemije se je za kratek čas povsem zaustavilo življenje in v pretežnem delu gospodarstva tudi poslovanje.
Delodajalci so bili čez noč soočeni s potrebo po drugačni organizaciji delovnega procesa, vse za ohranjanje delovanja podjetij,
doseganje gospodarskih ciljev in s tem ohranjanje delovnih mest. V ospredje urejanja delovnopravnih razmerij so prišli instituti
delovnega prava, ki se v praksi do zdaj niso pogosto uporabljali, in sicer čakanje na delo, delo od doma, nezmožnost opravljanja dela
zaradi višje sile in odreditev opravljanja drugega dela. Na področje urejanja delovnopravnih razmerij med epidemijo covida-19 je
posegla država s sprejemanjem interventnih zakonov, s katerimi želi omiliti posledice krize za gospodarstvo in državljane. V tem
prispevku je predstavljen delovnopravni okvir, ki ureja pravice in obveznosti delavcev in delodajalcev, od zakona, ki ureja delovna
razmerja, do ureditve v interventnih zakonih, ki se nanaša na urejanje delovnopravnih razmerij. Predstavljeni pa so tudi posamezni
instituti delovnega prava, katerih uporaba je v ospredju od razglasitve epidemije covida-19.
POVZETEK ČLANKA V ANGLEŠČINI
The outbreak of the SARS-CoV-2 epidemic has brought many challenges to employers in both the private and public
sectors, not only in terms of providing liquidity but also in terms of organising the work process and regulating employment relationships
with employees. With the first wave of the outbreak of the epidemic, life and business in the majority of the economy were completely
locked down for a short time. Employers were faced overnight with the need for a different organisation of the work process, all with the
aim of maintaining the operation of companies, achieving economic goals and thus preserving jobs. The institutes of labour law, which
have not been widely used in practice so far, have come to the fore, namely lay-off personnel, teleworking, inability to perform work due
to force majeure and ordering to perform other work. The state intervened in the field of regulation of labour relations during the SARS-
CoV-2 epidemic by adopting intervention laws with which the state wants to mitigate the consequences of the crisis for the economy and
citizens. This article will present the labour law framework that regulates the rights and obligations of employees and employers, from the
law governing employment relationships to the regulation in intervention laws relating to the regulation of labour relations. Individual
institutes of labour law, the use of which came to the fore when the SARS-CoV-2 epidemic was declared, will also be presented.
