POVZETEK
Čeprav so vprašanja bodočega normativnega urejanja prostorskega načrtovanja številna in obsežna in javno predstavljeni osnutek Zakona o urejanju prostora prinaša številne spremembe, a vendarle ne rešuje vseh (pravnih) dilem, se prispevek omejuje zlasti na problematiko občinskega podrobnega prostorskega načrta (OPPN). Vseeno je uvodni del namenjen nekoliko širšem razmisleku o (za vse izvedbene prostorske akte) pomembnem vprašanju iskanja ravnotežja med pravno varnostjo in (v praksi potrebno) prožnostjo prostorskega načrtovanja oziroma vprašanju želene stopnje konkretizacije zahtev in omejitev poseganja v prostor. V ta namen je vključen tudi kratek oris sedanjih in preteklih izkušenj o (normativnih) vzrokih prevelike togosti prostorskih aktov. Kot protiutež očitani neprožnosti so v prispevku okvirno predstavljene tudi predvidene novosti, ki naj bi v prostorsko načrtovanje vnesle več fleksibilnosti. V nadaljevanju so obravnavane težave OPPN v veljavni ureditvi in zlasti njeni praktični izvedbi in razlogi, zaradi katerih podpiram uvedbo formaliziranega postopka odločanja o OPPN na pobudo investitorja. Na koncu je predstavljen tudi pogled na predvideno bodočo ureditev OPPN, še posebej možnost, da se na investitorjevo pobudo z OPPN spremeni osnovna namenska raba, določena z OPN (t. i. OPPN za izjemno širitev stavbnih zemljišč).
SUMMARY
Although practical and legal issues that have to be tackled by future regulation of spatial planning are numerous and although publicly presented draft of a Spatial Planning Act brings many changes, but still leaves open some important questions, a content of this article is limited in focusing mostly on the issue of a municipal detailed plan (Slovene: občinski podrobni prostorski načrt or OPPN). However, the introductory part is devoted to a slightly wider reflection on (for all implementing spatial planning acts) important issue of searching a balance between a legal security and (in practice required) flexibility of spatial planning. Explores a question of desired degree of concretization of requirements and restrictions for building and other intervention in physical space already on the level of spatial planning. For this purpose, a brief outline of current and past experience of (normative) causes for excessive rigidity of spatial planning documents is included. As a counterweight to the alleged inflexibility of spatial planning acts, the article presents an outline of the envisaged legal instruments that aim to broaden flexibility of spatial planning. After that, problematic issues of existing municipal detailed plans (OPPN) are addressed and reasons for my support of an introduction of a formalized decision-making process on OPPN at the initiative of the investor are explained. Finally, a view of the projected future regulation of such plans is presented, in particular a possibility that (based on an investor’s initiative) a prescribed land use, determined by higher planning act (OPN), is changed.
