POVZETEK
Tisti, ki se ukvarjamo z upravnim procesnim pravom poglobljeno, akademsko ali vsakodnevno praktično pri vodenju upravnih postopkov, smo z zanimanjem prisluhnili idejam ob nastopu aktualne vlade leta 2022 o prožnejšem in sodobnim tujim zakonom primerljivem slovenskem Zakonu o splošnem upravnem postopku (ZUP). V ta namen je bilo v preteklih dveh letih storjenih več korakov, dokončna podoba (morebitnih) sprememb pa še ni jasna. Za pravno ureditev po ZUP v Sloveniji v prihodnje pričakujemo, da bo zakon bolj pripomoček kot ovira učinkovitemu, tj. zakonitemu in vendar razmeroma hitremu upravnemu odločanju, tako da bo odslikaval značilnosti sprememb v družbi in mednarodnih rešitev. Seveda le zakon ne more uveljaviti sodobnejše miselnosti, zato bodo ob novem zakonu potrebne aktivnosti usposabljanja in ozaveščanja. Spremembe pa naj bodo premišljene in sloneče na dobrih izkušnjah izvajanja upravnih postopkov in sodnega nadzora pri nas in širše, kot prikazuje tudi strokovna literatura. Če pride do posega v ZUP, to pač vpliva na milijone zadev, zato je skrajni čas za prebojne spremembe, toda te naj se normirajo in uvajajo s tresočo roko in trezno glavo.
SUMMARY
Those of us who engage deeply with administrative procedural law, whether academically or through managing daily administrative procedures, have taken a keen interest in the ideas proposed by the current government in 2022 regarding a more flexible and modern Slovenian General Administrative Procedure Act (ZUP). Over the past two years, several steps towards this have been undertaken, yet the final outlook of the potential changes remains unclear. Looking to the future legal regulation under the ZUP in Slovenia, we anticipate a law that serves more as a facilitator than a barrier to effective and expedient administrative decision-making. It should reflect the societal changes and international solutions. However, the law alone cannot foster a modern mindset; hence, training and awareness-raising activities will be required alongside the new law. Any changes should be thoughtful, drawing on positive experience of implementing administrative procedures and judicial oversight, both domestically and internationally, as suggested by professional literature. Given that alterations to the ZUP could impact millions of cases, the need for significant, yet carefully standardised and prudently implemented changes is pressing.
