POVZETEK
Prispevek prikazuje glavne spremembe, ki jih je v pritožbeni postopek vnesla novela Zakona o pravdnem postopku ZPP-E, in opozarja na nekatere morebitne nejasnosti oziroma vprašanja, ki se utegnejo pri uporabi novih določb pojaviti v praksi. Uvedena je možnost izdaje nadomestne sodbe, s katero lahko sodišče prve stopnje sámo odpravi nekatere utemeljeno očitane postopkovne napake, vezane na izdelavo sodbe. Za učinkovitejše omejevanje kasacijskih pooblastil pritožbenega sodišča je kot novost predvidena pritožba zoper sklep o razveljavitvi sodbe sodišča prve stopnje, o kateri prednostno in neobrazloženo odloča Vrhovno sodišče. V gospodarskih sporih pa je predvidena novost obvestilo stranki, da njena pritožba nima možnosti za uspeh, če je senat soglasen, da je pritožba očitno neutemeljena in da zadeva ni pomembna za sodno prakso. Če stranka potem pritožbo umakne, se ji vrne del sodne takse. Cilj vseh teh novosti je zmanjšanje števila razveljavitev sodb sodišč prve stopnje in s tem skrajšanje predvidenega časa sojenja. Z novelo je tudi podaljšan rok za vložitev pritožbe zoper sodbo sodišča prve stopnje s petnajst na trideset dni.
SUMMARY
In the article the main changes introduced into the appeal procedure by the amendments to the Civil Procedure Act ZPP-E are described, and the attention is drawn to some possible uncertainties and questions that may arise in practice when applying the new provisions. The possibility of issuing a substitute judgment has been introduced, whereby the court of first instance itself may eliminate certain procedural errors related to the drafting of a judgment. In order to limit the cassation powers of the appellate court more effectively, the appeal against the decision to annul the judgment of the first instance court is introduced. It will be decided by the Supreme Court as priority and without reasoning. In commercial disputes, there is new option for the appellate court panel to inform the party that its appeal has no chance of success if the panel holds unanimously that the appeal is manifestly unfounded and that the case is not relevant to the case-law. If the appellant then withdraws its appeal, a part of the court fee will be returned. The aim of all these novelties is to reduce the number of the annulment of the judgments of the courts of first instance, and thus reduce the anticipated trial time. The amendment also extended the deadline for lodging an appeal against the judgment of the
court of first instance from 15 to 30 days.
