POVZETEK
Predsednik republike je po Ustavi izrecno pristojen predlagati predsednika vlade, sodnike Ustavnega sodišča in pet članov sodnega sveta, ne pa tudi imenovati državnih funkcionarjev. Te lahko imenuje samo, kadar je to določeno z zakonom. Take pristojnosti doslej ni določil še noben zakon, so pa posamezni zakoni določili, nove (predlagalne) pristojnosti, čeprav Ustava tega ne predvideva. Ti so Predsednika republike pooblastili, da predlaga Varuha človekovih pravic, predsednika in dva namestnika Računskega sodišča, guvernerja, viceguvernerja in člane sveta Banke Slovenije, Informacijskega pooblaščenca in kandidate za sodnike mednarodnih sodišč. Tako ravnanje je ustavno sporno, saj so zakoni določili Predsedniku republike nove pristojnosti brez ustavne podlage. Zakonodajalec, ki je s tem v nasprotju z Ustavo razširil predsednikove pristojnosti, bi moral te zakonske določbe odpraviti ali pa jih urediti v Ustavi.
Poleg tega bi bilo smiselno in skladno s primerljivimi ureditvami ustrezneje urediti tudi druge pristojnosti Predsednika republike v postopkih imenovanja državnih funkcionarjev na način, da bi jih imenoval in ne predlagal v imenovanje oziroma izvolitev parlamentu. Predlagalna funkcija Predsednika republike namreč ni skladna z njegovim ustavnim položajem, utemeljenem na parlamentarnem sistemu in načelu delitve oblasti, v katerem ima pretežno reprezentativno funkcijo.
SUMMARY
The Constitution of the Republic of Slovenia explicitly authorizes the President of the Republic to propose the president of the government, judges of the Constitutional Court and five members of the Judicial Council, however it does not include state officials. The President may appoint them only when required by law. No Such power has been enacted by law so far, but several of them have however determined new powers of appointment, although the provides Constitution no legal basis for this. These are the power of the President of the Republic to propose the Ombudsman, the president and two deputies of Court of Audit, the Governor and deputy Governor of the Bank of Slovenia, the Commissioner for Access to Public Information and candidates for judges of international courts. Such conduct is constitutionally questionable, as the law establish new powers of the President of the republic without proper
constitutional basis. The legislature has thus contrary to the Constitution expanded powers of the President as those powers should be regulated in the
Constitutions. In addition, it would be reasonable and in line with comparable arrangements to regulate additional powers of the President of the Republic in
the nomination procedures of state officials in a way that the President would designate and not just propose the candidate for appointment or election to
parliament. Nominating function of the President of the republic is not in coherence with its constitutional position, based on a parliamentary system and the principle of separation of powers, where his function is more or less representative.
