POVZETEK
Prispevek obravnava tri vidike prodaje nepremičnine v izvršilnem postopku: prodajno ceno, položaj dolžnika po prodaji stanovanja ali individualne stanovanjske hiše, v kateri prebiva, in položaj kupca nepremičnine. Avtorica ugotavlja, da je Zakon o izvršbi in zavarovanju s tem, ko je znižal prodajno ceno na eno polovico ocenjene vrednosti, kot tudi s tem, da je omejil pravico dolžnika, da še naprej prebiva v prodanem stanovanju oziroma hiši in možnost odloga izvršbe za njegovo izselitev dolžnika iz prodanega stanovanja oziroma hiše, nedvomno povečal možnosti za prodajo nepremičnine in s tem prispeval k večji učinkovitosti izvršbe. Sprašuje pa se, ali je zakonodajalcu uspelo preprečiti možnost preprečil možnost zlorab, do katerih lahko pride pri prodaji, in ali je v zadostni meri poskrbel za varstvo temeljnih pravic dolžnika, kadar je zaradi izselitve ogrožena njegova eksistenca, saj mu ni treba zagotoviti niti minimalnih pogojev za bivanje.
SUMMARY
The paper deals with three aspects of the sale of immovables in the execution proceeding: the selling price, the position of the debtor after the sale of his apartment or his dwelling house and the legal position of the buyer. The author establishes that The Act on Execution and Protective Measures has, by lowering the selling price to one half of the appraised value of an immovable, as well as by limiting the right of the debtor to reside in a sold apartment or dwelling house and by limiting the possibility of the stay of the execution for the ejectment of the debtor from a sold apartment or dwelling house, undoubtedly increased the possibility for the successful sell of an immovable and contributed to the efficiency of the execution. However, she doubts whether the legislator succeeded to prevent the abuses and to protect the basic rights of the debtor when his existence is threatened by the ejectment from his apartment while it is not necessary to secure him even minimal dwelling conditions.
