Na podlagi petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 113/03 – uradno prečiščeno besedilo, 20/06 – ZNOMCMO in 76/08) izdaja Vlada Republike Slovenije

O RATIFIKACIJI DOGOVORA MED CARINSKO UPRAVO REPUBLIKE SLOVENIJE TER CARINSKO IN FINANČNO STRAŽO REPUBLIKE MADŽARSKE O POSTOPKU IZMENJAVE PODATKOV, OBRAVNAVANIH KOT CARINSKE INFORMACIJE ZA NAMENE NADZORA

1. člen

Ratificira se Dogovor med Carinsko upravo Republike Slovenije ter Carinsko in finančno stražo Republike Madžarske o postopku izmenjave podatkov, obravnavanih kot carinske informacije za namene nadzora, podpisan v Tarcalu 16. oktobra 2008.

2. člen

Dogovor se v izvirniku v angleškem jeziku in prevodu v slovenskem jeziku glasi:
Arrangement
Between the Customs Administration of the Republic of Slovenia and the Customs and Finance Guard of the Republic of Hungary on the rules of procedure for exchanging data regarded as customs information for control purposes
The Customs Administration of the Republic of Slovenia and the Customs and Finance Guard of the Republic of Hungary (hereinafter: Contracting Parties),
CONSIDERING that preventing and detecting customs and tax fraud in the framework of the Customs Union requires close cooperation between the customs authorities of the two Member States,
ESTABLISHING that mutual assistance can be provided on the basis of the Agreement between the Government of the Socialist Federal Republic of Yugoslavia and the Government of the People’s Republic of Hungary regarding cooperation and mutual assistance in customs matters, signed on 29 March 1978 and on the Council Regulation (EC) No 515/97 on mutual assistance between the administrative authorities of the Member States and cooperation between the latter and the Commission to ensure the correct application of the law on customs and agricultural matters,
RECOGNIZING that the Contracting Parties have appropriate administrative cooperation within their own Member States,
ESTABLISHING that no reason has occurred for excluding this Arrangement in the concerned Member States regarding data protection aspects,
HAVE AGREED AS FOLLOWS:

Article 1

Scope of the Arrangement

In order to ensure the conditions for control tasks deriving from EU membership, the Contracting Parties shall mutually exchange data which are available in their databases.

Article 2

Legal basis of data exchange

The Agreement between the Government of the Socialist Federal Republic of Yugoslavia and the Government of the People’s Republic of Hungary regarding cooperation and mutual assistance in customs matters, signed on 29 March 1978 and the Council Regulation (EC) No 515/97 on mutual assistance between the administrative authorities of the Member States and cooperation between the latter and the Commission to ensure the correct application of the law on customs and agricultural matters represent the legal basis of data exchange.

Article 3

Scope of data to be exchanged

The Contracting Parties will exchange data from import/export customs declarations issued in the commercial trade where the holders of the procedure have habitual residence or principal place of business in the State of the other Contracting Party, and data from import / export customs declarations where the State of the other Contracting Party is indicated as the final destination of imported goods.
The Contracting Parties shall set the detailed rules of data transfer in a Letter of Intent.

Article 4

Transmission of data

The Contracting Parties agree that the exchanged data can be further transmitted for control purpose to the respective national tax authorities in accordance with their national legislation, as follows:
– From the Customs Administration of the Republic of Slovenia to the Tax Administration of the Republic of Slovenia
– From the Customs and Finance Guard of the Republic of Hungary to the Tax and Financial Control Administration of the Republic of Hungary, respectively.

Article 5

Timing of data exchange

After the Arrangement enters into force, the Contracting Parties shall notify each other in writing when they are ready to commence data exchange.
Data shall be mutually exchanged once a month until the 25th day of the month following the month in question.

Article 6

Contact persons

The Contracting Parties shall, within 60 days of the date of entry into force of this Arrangement, exchange names of designate contact persons to facilitate communication between them on any matter covered by this Arrangement.

Article 7

Implementation of the Arrangement

The implementation of this Arrangement shall be entrusted to:
on behalf of the Customs Administration of the Republic of Slovenia:
– General Customs Directorate;
on behalf of the Customs and Finance Guard of the Republic of Hungary:
– Customs Directorate of the Directorate General.

Article 8

Entry into force and termination

This Arrangement shall enter into force on the date of receipt by the Republic of Hungary of the Slovenian notification that all internal legal procedures necessary for entry into force of the Arrangement have been completed.
This Arrangement shall be concluded for an indefinite period of time. The Arrangement can be terminated by a written notice by any of the Contracting Parties. The Arrangement shall be terminated six months after such notification has been received by the other Contracting Party. Ongoing proceedings at the time of termination shall be completed in accordance with the provisions of this Arrangement.
Signed in Tarcal on 16 October 2008 in two original copies in the English language.

Med Carinsko upravo Republike Slovenije ter Carinsko in finančno stražo Republike Madžarske o postopku izmenjave podatkov, obravnavanih kot carinske informacije za namene nadzora
Carinska uprava Republike Slovenije ter Carinska in finančna straža Republike Madžarske (v nadaljevanju pogodbenici) sta se
OB UPOŠTEVANJU, da preprečevanje in odkrivanje carinskih in davčnih goljufij v Carinski uniji zahtevata tesno sodelovanje med carinskimi organi obeh držav članic,
OB UGOTOVITVI, da je medsebojno pomoč mogoče zagotoviti na podlagi Sporazuma med Vlado Socialistične federativne republike Jugoslavije in Vlado Ljudske republike Madžarske o sodelovanju in vzajemni pomoči pri carinskih vprašanjih z dne 29. marca 1978 ter na podlagi Uredbe Sveta (ES) št. 515/97 o medsebojni pomoči med upravnimi organi držav članic in o sodelovanju med njimi in Komisijo zaradi zagotavljanja pravilnega izvajanja carinske in kmetijske zakonodaje,
OB UGOTOVITVI, da imata pogodbenici ustrezno upravno sodelovanje v okviru svojih držav članic,
OB UGOTOVITVI, da ni razloga, da se ta dogovor v teh dveh državah članicah ne bi uporabljal zaradi varstva podatkov,
DOGOVORILI:

1. člen

Predmet dogovora
Da bi zagotovili možnosti za opravljanje nalog nadzora, ki izhajajo iz članstva v EU, si pogodbenici izmenjavata podatke, ki so na voljo v njunih podatkovnih zbirkah.

2. člen

Pravna podlaga za izmenjavo podatkov
