O RATIFIKACIJI MEMORANDUMA O SOGLASJU MED VLADO REPUBLIKE SLOVENIJE IN VLADO REPUBLIKE MAKEDONIJE O SODELOVANJU NA PODROČJU JAVNIH FINANC

Ratificira se Memorandum o soglasju med Vlado Republike Slovenije in Vlado Republike Makedonije o sodelovanju na področju javnih financ, podpisan v Ljubljani 4. aprila 2003.

BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE GOVERNMENT OF THE REPUBLIC OF MACEDONIA ON  COOPERATION IN THE AREA OF PUBLIC FINANCE

This memorandum serves as a basis for the cooperation between the Government of the Republic of Slovenia and the Government of the Republic of Macedonia in providing technical assistance of the Republic Slovenia in the area of public finance.
    The Government of the Republic of Slovenia and the Government of the Republic of Macedonia (hereinafter referred to as “contracting parties”) have, with the purpose of establishing the basis for close cooperation in the area of training and educating in the area of public finance
    agreed on the following:

1. OBJECTIVES

1.1. Considering that public finance reforms, aiming at updating the system of collecting, managing and disbursing public finance, including the design of the Customs and Tax Administrations and public procurement procedures, are of exceptional importance for future economic development at the national and regional level; the contracting parties hereto have agreed on technical assistance, provided by the Government of the Republic of Slovenia to the Government of the Republic of Macedonia.
    1.2. To this purpose, the Government of the Republic of Slovenia shall, in the context of training programs for civil servants of the Republic of Macedonia, provide training in the area of public finance, including the transfer of know-how and experience, gained during the implementation of public finance reforms in Slovenia.

2. METHOD OF IMPLEMENTATION

2.1. Each activity launched on the basis of this memorandum shall be implemented on a consensual basis.
    2.2. On behalf of the Government of the Republic of Slovenia the technical assistance defined in Article 2.5.(1) shall be coordinated by the Center of Excellence in Finance (hereinafter referred to as “Center”), and technical assistance defined in Articles 2.5.(2) and 2.5.(3) by the Ministry of Finance of the Republic of Slovenia. On behalf of the Government of the Republic of Macedonia the coordination shall be managed by the Ministry of Finance of the Republic of Macedonia (hereinafter referred to as “coordinators”).
    2.3. The Government of the Republic of Slovenia will assure the technical assistance on the basis of needs of the Government of the Republic of Macedonia proposed in its programme. The Government of the Republic of Macedonia shall be able to present its proposals and priorities for the training of public servants in the area of public finance at the sessions of the Center’s Supervisory Board, which it is a member of or directly to the Ministry of Finance of the Republic of Slovenia throughout the year.
    2.4. Such technical assistance of the Government of the Republic of Slovenia shall rely on the expertise of civil servants and competent experts, both native and foreign.
    2.5. The technical assistance shall be performed by means of:
    (1) training programs, organized by the Center,
    (2) on-site visits of the representatives of the Republic of Macedonia in Slovenia or representatives of the Republic of Slovenia in Macedonia, and
    (3) other forms of cooperation that the contracting parties may agree upon.
    2.6. With regard to the training programs defined in Article 2.5.(1) the Center shall ensure at least three (3) places for civil servants from the Republic of Macedonia for each seminar on its work program.
    2.7. Other forms of technical assistance from Article 2.5. shall be provided on the basis of written applications from the Ministry of Finance of the Republic of Macedonia, containing, but not limiting itself to:
    (1) the required area of assistance,
    (2) objectives of training,
    (3) period of duration,
    (4) number of participants and theirs occupational areas,
    (5) estimated costs of visit and their defrayal.
    2.8. The Ministry of Finance of the Republic of Slovenia shall decide on each application within a reasonable time, whereas the coordinators shall agree on the method and conditions of training in detail through mutual communication in writing. Following an agreement, the Ministry of Finance of the Republic of Slovenia shall prepare a proposal on the method of implementation of the technical assistance to be confirmed by coordinators.

3. FINANCIAL TERMS OF COOPERATION

3.1. Funds provided for technical assistance shall be planned on budget items of the Ministry of Finance of the Republic of Slovenia. The technical assistance is inclusive of all costs, arising out of performing all three forms of technical assistance defined in Article 2.5. and is covered in accordance with the provisions of Article 3.2. and 3.3. of this memorandum.
    3.2. The Government of the Republic of Slovenia shall cover the costs of the seminars in the event that the seminars take place in Slovenia, and the costs of travel, accommodations and other expenses of its representatives during on-site visit in the Republic of Macedonia.
    3.3. The Government of the Republic of Macedonia shall cover the costs of seminars in the event that the seminars take place in Macedonia and the costs of travel, accommodation and other expenses for its participants on seminars in Slovenia. In addition, the Government of the Republic of Macedonia shall cover the costs of translation, which shall be needed for training of civil servants that are not fluent in English.

4. DURATION AND ENTRY INTO FORCE OF THE MEMORANDUM

4.1. This memorandum shall enter into force on the day of the receipt of the last official notification about the fulfilment of their respective ratification procedures. Notwithstanding the above, this memorandum shall be provisionally applied from the date of its signature.
    4.2. This Memorandum shall be in force for the period of two (2) years and shall be automatically renewed for successive periods of one year, unless one of the contracting parties notifies the other at least three months before the expiry of this period about its termination.
    4.3. Upon the termination of this memorandum, all the cooperation programmes concluded on the basis of this memorandum shall be completed.
    4.4. This Memorandum is concluded in two originals in the English language.

Ta memorandum je podlaga za sodelovanje med Vlado Republike Slovenije in Vlado Republike Makedonije pri zagotavljanju strokovne pomoči Republike Slovenije na področju javnih financ.
Vlada Republike Slovenije in Vlada Republike Makedonije (v nadaljevanju: pogodbenici) sta se z namenom, da ustvarita podlago za tesno sodelovanje pri usposabljanju in izobraževanju na področju javnih financ,
dogovorili:
1 CILJI
1.1 Glede na to, da je reforma javnih financ, katere cilj je posodobiti sistem pobiranja javnih prihodkov, upravljanja in izplačevanja proračunskih sredstev, vključno z organizacijo carinske in davčne uprave, in postopke izvajanja javnih naročil, izjemnega pomena za prihodnji gospodarski razvoj na državni in regionalni ravni, sta se pogodbenici dogovorili za strokovno pomoč, ki jo Vlada Republike Slovenije zagotavlja Vladi Republike Makedonije.
1.2 Da bi to dosegla, Vlada Republike Slovenije v okviru programov usposabljanja javnih uslužbencev Republike Makedonije na področju javnih financ zagotavlja usposabljanje, vključno s prenosom znanja in izkušenj, pridobljenih pri izvajanju reforme javnih financ v Sloveniji.
2 NAČIN IZVAJANJA
2.1 Vsaka dejavnost, ki se začne na podlagi tega memoranduma, se izvaja sporazumno.
