Na podlagi tretjega odstavka 63. člena Zakona o zunanjih zadevah (Uradni list RS, št. 1/91-I) izdaja Vlada Republike Slovenije

O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN SVETOM MINISTROV BOSNE     IN HERCEGOVINE O DAJANJU NEVRAČLJIVE POMOČI BOSNI IN HERCEGOVINI ZA LETO 1999

1. člen

Ratificira se Sporazum med Vlado Republike Slovenije in Svetom ministrov Bosne in Hercegovine o dajanju nevračljive pomoči Bosni in Hercegovini za leto 1999, podpisan v Sarajevu 14. decembra 1999.

2. člen

Sporazum se v izvirniku v angleškem jeziku in v prevodu v slovenskem jeziku glasi:
A G R E E M E N T
BETWEEN THE GOVERNMENT OF THE REPUBLIC OF SLOVENIA AND THE COUNCIL     OF MINISTERS OF BOSNIA AND HERZEGOVINA ON EXTENDING GRANT AID TO BOSNIA     AND HERZEGOVINA IN 1999

The Government of the Republic of Slovenia and the Council of Ministers of Bosnia and Herzegovina (hereinafter Parties in the Agreement) desiring to develop and strengthen the mutual friendly relations between the two countries, define through this Agreement conditions of extending and implementation of grant aid of the Republic of Slovenia to Bosnia and Herzegovina, according to commitments given in the Fifth Donors‘ Pledging Conference for Bosnia and Herzegovina in Brussels.

Article 1

In the 1999, the Republic of Slovenia committed to Bosnia and Herzegovina grant aid in the amount of 3,175,100.00 USD (three million one hundred and seventy five thousand one hundred USD), which is to be implemented in the form of reconstruction projects and technical assistance, stated in the Specification attached hereto forming an integral part of the Agreement.
    Costs incurred in the transportation and insurance of the goods within the framework of reconstruction projects delivered to a destination in Bosnia and Herzegovina shall be covered by financial resources of the grant aid referred to in the first paragraph of this Article.

Article 2

The Government of the Republic of Slovenia will deliver a part of the grant under the specification in goods delivered duty unpaid (DDU) destination in Bosnia and Herzegovina.

Article 3

The Government of the Federation of Bosnia and Herzegovina and the Government of the Republika Srpska will take over the goods within the framework of reconstruction projects on behalf of the Council of Ministers of Bosnia and Herzegovina, determine final beneficiaries of the aid and carry out control of distribution of the goods.

Article 4

The authorities of Bosnia and Herzegovina will ensure issuing of all necessary permits for import of the goods within the framework of reconstruction projects. All imports carried out under the present Agreement and their associated services will be exempted from customs duties, import duties or other fiscal charges.
    From time to time, Parties in the Agreement will exchange information and opinions on carrying out distribution of the goods within the framework of reconstruction projects and their implementation hereunder.

Article 5

Parties in the Agreement will resolve all possible disputes which may arise in connection with the interpreting and application of the Agreement in a friendly manner.

Article 6

This Agreement shall enter into force on the date of the receipt of the last of notifications for the entry into force of this Agreement.
    This Agreement can be changed only after written agreement of Parties hereto.
    Made in Sarajevo on 14th December, 1999, in two copies in English language.

S P O R A Z U M
MED VLADO REPUBLIKE SLOVENIJE IN SVETOM MINISTROV BOSNE IN HERCEGOVINE     O DAJANJU NEVRAČLJIVE POMOČI BOSNI     IN HERCEGOVINI ZA LETO 1999
Vlada Republike Slovenije in Svet ministrov Bosne in Hercegovine (v nadaljevanju pogodbenici) v želji, da razvijeta in okrepita vzajemne prijateljske odnose med državama, s tem sporazumom določata pogoje za dajanje in izvajanje nevračljive pomoči Republike Slovenije Bosni in Hercegovini v skladu z obveznostmi, ki so bile sprejete na Peti konferenci donatorjev za Bosno in Hercegovino v Bruslju.

1. člen

Republika Slovenija se je za leto 1999 zavezala dati Bosni in Hercegovini nevračljivo pomoč v višini 3.175.100,00 USD (tri milijone sto petinsedemdeset tisoč sto ameriških dolarjev), ki se izvaja v obliki projektov obnove in strokovne pomoči, navedenih v prilogi, ki je sestavni del tega sporazuma.
