Na podlagi petega odstavka 75. člena Zakona o zunanjih zadevah (Uradni list RS, št. 45/01) izdaja Vlada Republike Slovenije
U R E D B O O RATIFIKACIJI SPORAZUMA MED VLADO REPUBLIKE SLOVENIJE IN VLADO ZDRUŽENIH DRŽAV AMERIKE O OMOGOČANJU PRELETOV IN TRANZITOV PREKO REPUBLIKE SLOVENIJE Z NAMENOM PODPORE VARNOSTI, TRANZICIJI IN OBNOVITVENIM OPERACIJAM V IRAKU

1. člen

Ratificira se Sporazum med Vlado Republike Slovenije in Vlado Združenih držav Amerike o omogočanju preletov in tranzitov preko Republike Slovenije z namenom podpore varnosti, tranziciji in obnovitvenim operacijam v Iraku, sklenjen z izmenjavo not dne 9. junija 2003 in 11. junija 2003 v Ljubljani.

2. člen

Sporazum se v izvirniku v angleškem jeziku in v prevodu v slovenskem jeziku glasi:

    The Embassy of the United States of America presents its compliments to the Ministry of Foreign Affairs and on behalf of the Government of the United States of America has the honor to refer to United Nations Security Council Resolution 1483 of May 22, 2003 and recent discussions between the two governments regarding the overflight and transit through the territory and airspace of Slovenia by U.S. aircraft and personnel for purposes of supporting security, transition and reconstruction operations in Iraq.
    As a result of these discussions, the Embassy proposes that U.S. aircraft, including those carrying cargo, and U.S military personnel be authorized to overfly and transit through the territory and airspace of Slovenia for purposes of supporting security, transition and reconstruction operations in Iraq. The Embassy proposes further that the United States Government provide 24 hours notice to the Government of Slovenia of the types and number of such transiting aircraft, their tail numbers, and the routes to be flown.
    Additionally, it is proposed that such aircraft not be subject to the payment of landing and parking fees, or of navigation, overflight and terminal charges, but will pay reasonable charges for services requested and received and that the Agreement among the States Parties to the North Atlantic Treaty and the other States Participating in the Partnership for Peace Regarding the Status of Their Forces, done in Brussels on June 19, 1995, and entered into force on February 17, 1996, apply with respect to these flights, vehicles, and personnel.
    If the foregoing is acceptable to the Government of Slovenia, the Embassy proposes that this note, together with the Ministry’s reply, shall constitute an agreement between the two governments which shall be applied provisionally from the date of the Ministry’ s note and shall enter into force definitively on the date of the Ministry’ s note informing the Embassy that the Government of Slovenia has completed all of the necessary internal procedures required for the entry into force of the Agreement..
    The Embassy of the United States of America avails itself of this opportunity to renew to the Ministry of Foreign Affairs the assurances of its highest consideration.

    The Ministry of Foreign Affairs of the Republic of Slovenia presents its compliments to the Embassy of the United States of America and has the honor to acknowledge the receipt of Embassy’s Note No. 019/2003 of 9 June 2003 which reads as follows:

“The Embassy of the United States of America presents its compliments to the Ministry of Foreign Affairs and on behalf of the Government of the United States of America has the honor to refer to United Nations Security Council Resolution 1483 of May 22, 2003 and recent discussions between the two governments regarding the overflight and transit through the territory and airspace of Slovenia by U.S. aircraft, vehicles and personnel for purposes of supporting security, transition and reconstruction operations in Iraq.

    The Ministry of Foreign Affairs of the Republic of Slovenia has the honor to inform the Embassy that the foregoing is acceptable to the Government of the Republic of Slovenia. Therefore the Embassy’s Note and the present note constitute an agreement between the two governments. The Agreement shall provisionally be applied from the date of the present note and shall enter into force definitively on the date of the Ministry’s note informing the Embassy that the Government of the Republic of Slovenia has completed all of the necessary internal procedures required for its entry into force.
    The Ministry of Foreign Affairs of the Republic of Slovenia avails itself of this opportunity to renew to the Embassy of the United States of America the assurances of its highest consideration.

Veleposlaništvo Združenih držav Amerike izraža spoštovanje Ministrstvu za zunanje zadeve in ima v imenu Vlade Združenih držav Amerike čast sklicevati se na resolucijo Varnostnega sveta Združenih narodov št. 1483 z dne 22. maja 2003 in na nedavne razgovore med predstavniki obeh vlad glede preletov in tranzita letal in osebja Združenih držav čez ozemlje in skozi zračni prostor Slovenije za namene podpore varnostnim operacijam ter operacijam tranzicije in obnove v Iraku.
Na podlagi teh razgovorov veleposlaništvo predlaga, da zrakoplovi in vozila Združenih držav, vključno s tistimi, ki prevažajo tovor, in vojaško osebje Združenih držav dobijo dovoljenje za prelete čez ozemlje in skozi zračni prostor ter tranzit prek ozemlja Slovenije za namene podpore varnostnim operacijam ter operacijam tranzicije in obnove v Iraku. Veleposlaništvo prav tako predlaga, da Vlada Združenih držav 24 ur vnaprej obvesti Vlado Slovenije o tipu in številu letal v tranzitu, njihovih številkah na repu letala in smeri letenja.
