Non-compliance of machinery and equipment

V članku obravnavamo neskladnost strojev in opreme kot pomemben pravni, regulativni in vrednostni dejavnik pri ocenjevanju strojev in opreme. Pojasnjena je razlika med fizičnim stanjem strojev in opreme ter njihovo pravno skladnostjo. Prikazano je, kako lahko zakonodajne spremembe, iztek prehodnih obdobij ali sprememba namena uporabe povzročijo regulativno zastarelost in bistveno vplivajo na vrednost stroja. Prispevek sistematično predstavi evropski zakonodajni okvir (CE, ATEX, RoHS, REACH, EMC idr.), metodologijo vrednotenja po standardih MSOV/ASA ter razlikovanje med ozdravljivo in neozdravljivo neskladnostjo. S praktičnimi primeri in poudarkom na prihajajoči Uredbi (EU) 2023/1230 opozorimo na potrebo po vključevanju regulativnih tveganj v sodobno vrednotenje strojev in opreme.

The article deals with the non-conformity of machinery and equipment as an important legal, regulatory and value factor in the assessment of machinery and equipment. The difference between the physical condition of machinery and equipment and their legal conformity is explained. We explain how legislative changes, the expiration of transitional periods or a change in the intended use can cause regulatory obsolescence and significantly affect the value of a machine. The article systematically presents the European legislative framework (CE, ATEX, RoHS, REACH, EMC, etc.), the methodology for assessment according to IVS or ASA standards and the distinction between curable and non-curable non-conformity. With practical examples and an emphasis on the upcoming Regulation (EU) 2023/1230, we draw attention to the need to include regulatory risks in modern assessment of machinery and equipment.
