POVZETEK
V Zakonu o registraciji istospolne partnerske skupnosti (ZRIPS) je bila registracija partnerske zveze najvišja možna oblika njene formalne potrditve. Izraz registracija je tak kot pri drugih pravnih postopkih, kot je na primer registracija motornega vozila, ki človeka težko asociira na institut, podoben sklenitvi zakonske zveze. Novi zakon je na tem področju naredil korak naprej. Ne govorimo več o registraciji, ampak o sklenitvi partnerske zveze. Hkrati pa s tem novi zakon ni posegel v tradicionalno opredelitev zakonske zveze, ki je življenjska skupnost moškega in ženske, in prav tako ni posegel v voljo volivk in volivcev, ki so na referendumu že glasovali proti taki spremembi, ter je kljub temu ohranil ločnico med tradicionalnim dojemanjem pojmov zakonca, zakonske zveze ter istospolnih partnerjev. Kljub napredku na tem področju težko govorimo o pravi enakosti. Kar nekaj držav, predvsem v Evropi in Severni ter Južni Ameriki, je v zadnjih letih spremenilo tradicionalno opredelitev zakonske zveze in tako omogočilo njeno sklenitev tudi istospolnim parom. Vprašanje je, ali bo temu v prihodnosti sledila tudi Slovenija, bodisi s spremembo ZZZDR ali pa prek Ustavnega sodišča.

In the Civil Partnership Registration Act, the registration of a partnership was the highest possible form of its formal recognition. The term “registration” that was applied by the Act was the same as the term used for legal procedures such as registration of a car or a boat, and was hardly suitable for an institution similar to marriage, which is reserved for different sex couples. In this regard, the new Civil Union Act made a step forward. We no longer speak about registered partnership, but about civil unions. However, the new law did not interfere with the traditional definition of marriage, which is the legal union of a husband and a wife. The law thus respected the will of the voters who rejected such an amendment in a referendum and preserved the distinction between the traditional concept of a spouse and of marriage on the one side and samesex couples on the other. Regardless the progress made in this field, there is still no absolute equality. Quite a few countries, mainly in Europe and North and South America, have changed their definitions of marriage in recent years and opened it also for same-sex couples. The question is whether Slovenia is going to follow these countries in the near future, either through a change of legislation or through a decision of the Constitutional Court.
